Análisis Jurídico: el principio de interés superior del niño en los estudiantes de bachillerato de la Unidad Educativa Otavalo 2020-2021

Abstract
En el presente estudio se abordó la vulneración al principio de interés superior de los niños y adolescentes en la Unidad Educativa Otavalo durante las clases en línea, en virtud de que no existe información pertinente que permita conocer si se garantizó este principio\; por este motivo, fue necesario analizar las condiciones de la educación en línea para determinar la vulneración a este principio. El objetivo general fue determinar las razones del incumplimiento del principio al interés superior del niño en los estudiantes de bachillerato de la Unidad Educativa Otavalo en el período 2020-2021. Como antecedentes se evidenció que el Ministerio de Educación y la Unidad Educativa Otavalo no se encontraban preparados para implementar la educación virtual de manera apropiada y en consonancia con los derechos de los niños, niñas y adolescentes. Es así como, con el uso del enfoque cualitativo, el cual, a través del método socio jurídico y deductivo, permitió alcanzar los objetivos establecidos, además se empleó la técnica documental junto con la técnica de la entrevista. Los resultados obtenidos demostraron que existió deserción en estudiantes del bachillerato de la Unidad Educativa Otavalo debido a escasos recursos durante la pandemia, adicionalmente, se evidenció que aquellos estudiantes que pudieron continuar con sus estudios no recibieron educación de calidad. Finalmente, se concluyó que, debido a las razones expuestas anteriormente, existió vulneración al interés superior de los niños, niñas y adolescentes durante la realización de las clases en línea en el tiempo de pandemia.
In the present study, the violation of the principle of best interest of children and adolescents in the Otavalo Educational Unit during online classes was addressed, since there is no pertinent information that allows knowing if this principle was guaranteed; For this reason, it was necessary to analyze the conditions of online education to determine the violation of this principle. The general objective was to determine the reasons for non compliance with the principle of the best interest of the child in high school students of the Otavalo Educational Unit in the period 2020-2021. As background, it was evidenced that the Ministry of Education and the Otavalo Educational Unit were not prepared to implement virtual education appropriately and in line with the rights of children and adolescents. This is how, with the use of the qualitative approach, which, through the socio legal and deductive method, allowed the established objectives to be achieved, the documentary technique was also used together with the interview technique. The results obtained showed that there was dropout in high school students from the Otavalo Educational Unit due to scarce resources during the pandemic, additionally, it was evidenced that those students who were able to continue their studies did not receive quality education. Finally, it was concluded that, due to the reasons stated above, there was a violation of the best interests of children and adolescents during the online classes during the pandemic.
