Item Open Access Eficacia del sistema normativo de protección en tema de discriminación de las niñas afrodescendientes de cinco a doce años de edad en escuelas públicas del cantón Ibarra en el período del 2016-2018(Pontificia Universidad Católica del Ecuador Sede Ibarra, 2021-05) Andrade Tapia, Kassandra MishellThe effectiveness of the regulatory system of protection on the issue of discrimination against girls of African descent between the ages of five and 12 in public schools in Ibarra canton in the period 2016-2018 needs to be analyzed through the study of national and international standards as well as legal procedures and avenues for them. Identify aspects that have not been applied, as well as the legal instruments used to resolve such cases, and to specify whether within educational institutions they know and apply this regulatory system and what measures or procedures they consider. There is evidence of the inclusion of several international instruments such as the Declaration of Human Rights, the Convention on the Elimination of All Forms of Discrimination against Women and the International Convention on the Elimination of All Forms of Racial Discrimination within the Constitution and the Organic Law on Intercultural Education and its contents. In addition to the power of the Student Counseling Department, as the main body for prevention, promotion, treatment and compliance observer in cases of discrimination. Similarly, the disciplinary measures, protective measures and sanctions. It was determined that the regulatory system on the issue of ethnic discrimination in education is not completely effective. The investigation used the analytical method when studying national and international regulations, the socio-legal method when identifying whether educational institutions apply such regulations, and the hermeneutic method for the proper interpretation of the regulations. Ethno-education guarantees the eradication of discrimination in education by providing Afro-Ecuadorian children with the proper cultural appropriation, conservation, and appreciation of their culture, which is why it is necessary to implement it in the LOEI.
