Abstract
La Constitución de la República del Ecuador (2008) en el artículo 66 numeral 28
reconoce: El derecho a la identidad personal como un ente fundamental, con el fin
de reconocer la procedencia familiar de todas las personas garantizando así la
debida protección por parte del estado con el fin de permitir el conocimiento de los
orígenes de cada persona que ha sido concebida mediante técnicas de reproducción
heteróloga, lo cual en algunos estados se ha tomado de manera primordial ,el
acceso a este derecho de identidad personal , en donde las personas concebidas
por estos métodos al cumplir la mayoría de edad mediante vía judicial, pueden pedir
que se dé a conocer la identidad de su donante pero no podrán establecer ningún
vínculo filial y se proporcionará cierta remuneración económica con el fin de
colaborar con las molestias establecidas al donante, lo cual beneficia a la persona
que quiere obtener información ya sea por solucionar problemas de salud y por
garantizarse el derecho de conocer cuáles son sus orígenes y no desconocerlos.
Esta investigación es de carácter importante, en el ámbito del derecho con el fin de
analizar la prohibición que contemplan estas normativas para poner determinar
cuáles son los beneficios y consecuencias, que traería el hecho de beneficiar el
conocimiento de la identidad personal a las personas concebidas por métodos de
fecundación heteróloga, y poder así cumplir con el derecho constitucional que tienen
todas las personas el cual es inherente a la misma, y se lo concibe al momento de
nacer cumpliendo así con la normativa Constitucional Ecuatoriana. Siguiendo esta
normativa cada persona concebida por estas técnicas estaría facultada a conocer su
identidad personal complementando así el conocimiento de su origen, identidad y
hacer cumplir sus derechos que son inherentes a su persona.
The Constitution of the Republic of Ecuador (2008) in article 66 number 28 recognizes: The right to personal identity as a fundamental entity, in order to recognize the family origin of all persons guaranteed as well as protection by the state in order to allow knowledge of the origins of each person that has been conceived through heterologous reproduction techniques, which in some states has been taken primarily, access to this right of personal identity, where people who are have these methods to reach the age of majority through the courts, can ask to know the identity of their donor but can not offer any subsidiary link and offers a financial compensation in order to help with the inconvenience established to the donor, which benefits the person who wants to obtain information either for health problems and for change the right to know the child's origins s and do not ignore them. This research is of an important nature, in the field of law in order to analyze the prohibition that includes these normative norms to put the finger on the child's benefits and consequences, which would bring the fact that the knowledge of personal identity in people acquired by methods of heterologous fertilization, and thus be able to comply with the constitutional right that all people have which is inherent to it, and it is at the time of complying with the Ecuadorian constitutional regulations. Following this regulation, each person conceived by these techniques is entitled to know their personal identity, thus complementing the knowledge of their origin, identity and enforce their rights that are inherent in their person.
