Abstract
El presente trabajo de investigación realiza un análisis del derecho fundamental y humano de alimentos que tienen los hijos con respecto a los obligados directos como son sus padres, tomando en cuenta la normativa contenida en la Constitución de la República del Ecuador, el Código Civil así como también lo constante en el Código Orgánico de la Niñez y Adolescencia.
Partiendo de lo expuesto en líneas precedentes y ante la falta de obligados principales o directos, el ordenamiento jurídico ecuatoriano ha traspasado la obligación a determinados miembros de la familia, en calidad de obligados subsidiarios, sin determinar las reglas con las cuales se debe medir el pago de una pensión alimenticia por parte de quien no es padre ni madre del menor.
En razón de la existencia de obligados subsidiarios, el trabajo analiza la familia y las distintas formas como son concebidas de conformidad a disposiciones constitucionales.

Due to the existence of subsidiaries, the work analyzes the family and the different forms as they are conceived according to constitutional provisions.
