Estudio jurídico del derecho a la resistencia en Ecuador: restricciones y libertades

Abstract
La investigación se enfocó en analizar el derecho a la resistencia en Ecuador, mediante el estudio de las condiciones legales que determinan su ejercicio en el contexto de las libertades individuales y las restricciones impuestas por el Estado, con el fin de ofrecer un marco comprensivo que contribuya a la defensa de los derechos humanos y a la promoción de una mayor equidad en el ejercicio de la resistencia social. El estudio fue de naturaleza documental, con enfoque cualitativo, el nivel de profundidad fue descriptivo, con los métodos analítico-sintético, método socio-jurídico, con las técnicas de la revisión y el análisis documental, por último, las fichas como instrumento de compilación de información. Alcanzando como resultado que el derecho a la resistencia se describe por primera vez en la Constitución de la República, plasmada en su artículo 98 el derecho a la resistencia, en el que refiere que todas las personas de manera individual o colectiva, pueden resistir frente a las acciones u omisiones que realice el poder público o cualquier persona natural o jurídica, cuando se hayan vulnerado o se vayan a vulnerar los derechos reconocidos por la Constitución de la Republica del Ecuador. Concluyendo en que todas las personas se encuentran facultadas a ejercer el derecho a la resistencia dentro de los límites legales, sin embargo, si este se excede puede traer connotaciones penales, por cuanto, si al protestar se emplea la violencia y se actúa con la finalidad de derrocar al gobierno desconociendo la Constitución, serán sancionadas. Partiendo de esa premisa, este derecho debe ser ejercido de manera pacífica caso contrario podría configurarse como una conducta punible si su finalidad es derrocar al gobierno o desestabilizar el Estado, desconociendo la carta fundamental.
The research focused on analyzing the right to resistance in Ecuador, by studying the legal conditions that determine its exercise in the context of individual freedoms and restrictions imposed by the State, in order to offer a comprehensive framework that contributes to the defense of human rights and the promotion of greater equity in the exercise of social resistance. The study was of a documentary nature, with a qualitative approach, the level of depth was descriptive, with analytical-synthetic methods, socio-legal method, with the techniques of documentary review and analysis, and finally, the records as an instrument for compiling information. Reaching as a result that the right to resistance is described for the first time in the Constitution of the Republic, embodied in its article 98 the right to resistance, which refers that all people individually or collectively, can resist against the actions or omissions carried out by the public power or any natural or legal person, when the rights recognized by the Constitution of the Republic of Ecuador have been violated or are going to be violated. Concluding that all people are empowered to exercise the right to resistance within the legal limits, however, if this is exceeded it can bring penal connotations, because, if violence is used when protesting and acts are done with the purpose of overthrowing the government, ignoring the Constitution, they will be sanctioned. Starting from this premise, this right must be exercised peacefully, otherwise it could be configured as a punishable conduct if its purpose is to overthrow the government or destabilize the State, ignoring the fundamental charter.
