Abstract
En Ecuador, las comunidades indígenas enfrentan desafíos particulares en la gestión de conflictos internos, como disputas territoriales o problemas de liderazgo, que tradicionalmente son resueltos por la justicia indígena, basada en principios indígenas. El objetivo general fue analizar la denominación de que es conflicto interno que da la Corte Constitucional del Ecuador en la sentencia 1-12 EI/21. El enfoque de la investigación fue cualitativo puesto que se analizaron los comportamientos y las actitudes dentro de las comunidades indígenas y su conocimiento sobre los conflictos internos y cómo se relaciona con la sentencia 1-12 EI/21, en base a los lineamentos que dicta la Corte Constitucional. Es un estudio descriptivo sobre el sistema de justicia indígena, se emplearon métodos antropo-jurídico, analítico y hermenéutico, las técnicas utilizadas incluyen la revisión documental con el análisis de las sentencias 1-12 EI/21 y 2-19-EI/21 y utilizando la entrevista semiestructurada en el contraste de la información obtenida. Este caso subraya la necesidad de identificar adecuadamente los conflictos internos y aplicar principios que respeten tanto la autonomía indígena como los derechos humanos. Los resultados reflejan el constante desafío que se desarrolla en la contradicción que a veces surge entre las decisiones de la justicia indígena y la justicia ordinaria. Además, clarifica el contexto en el que se desarrollan los conflictos internos y las diferentes circunstancias en las que se pueden aplicar de acuerdo a los criterios que emana la Corte Constitucional sobre este punto.
In Ecuador, indigenous communities face particular challenges in the management of internal conflicts, such as territorial disputes or leadership problems, which are traditionally resolved by indigenous justice, based on indigenous principles. The general objective was to analyze the denomination of internal conflict given by the Constitutional Court of Ecuador in sentence 1-12 EI/21. The research approach was qualitative since it analyzed the behaviors and attitudes within the indigenous communities and their knowledge about internal conflicts and how it relates to the sentence 1-12 EI/21, based on the guidelines dictated by the Constitutional Court. It is a descriptive study on the indigenous justice system, anthropo-legal, analytical and hermeneutic methods were employed, the techniques used include documentary review with the analysis of sentences 1-12 EI/21 and 2-19-EI/21 and using the semi-structured interview in the contrast of the information obtained. This case highlights the need to properly identify internal conflicts and apply principles that respect both indigenous autonomy and human rights. The results reflect the constant challenge that develops in the contradiction that sometimes arises between the decisions of indigenous justice and ordinary justice. It also clarifies the context in which internal conflicts develop and the different circumstances in which they can be applied according to the criteria emanating from the Constitutional Court on this point.
