Abstract
La presente investigación aborda la temática de los convenios de pago como mecanismo para extinguir obligaciones en el sector público ecuatoriano, explorando su base legal y eficacia práctica. Este estudio profundiza en la normativa actual y su aplicación, destacando cómo estos convenios facilitan la gestión de las deudas estatales de manera que se equilibren los requerimientos de liquidez y la continuidad en la prestación de servicios públicos. Mediante un enfoque metodológico cualitativo que incluye análisis de doctrina, jurisprudencia y entrevistas con profesionales del sector, se examina la capacidad de estos convenios para resolver compromisos financieros de manera ética y conforme a la ley. La investigación revela una notable carencia de legislación específica que regule exhaustivamente estos convenios, situación que plantea desafíos significativos para su implementación efectiva. Se identifica la necesidad de fortalecer el marco legal para asegurar que los convenios de pago no solo satisfagan los requisitoslegales básicos, sino que también se gestionen bajo principios de transparencia y justicia, evitando prácticas corruptas o arbitrarias. Se argumenta que una regulación adecuada y detallada podría mejorar considerablemente la seguridad jurídica y la eficiencia en la administración pública. Además, se discute sobre las implicaciones de estos convenios en la sostenibilidad fiscal y la confianza pública, sugiriendo que un manejo apropiado puede fortalecer la gobernanza y promover la transparencia en la gestión pública. La investigación concluye que los convenios depago representan una herramienta valiosa y necesaria para la gestión de deudas estatales, pero escrucial abordar las lagunas legales y los retos prácticos para optimizar su efectividad y asegurar que contribuyan al bien común.
This research addresses the issue of payment agreements as a mechanism to extinguish obligations in the Ecuadorian public sector, exploring its legal basis and practical effectiveness. This study delves into current regulations and their application, highlighting how these agreements facilitate the management of state debts in a way that balances liquidity requirementsand continuity in the provision of public services. Through a qualitative methodological approachthat includes analysis of doctrine, jurisprudence, and interviews with professionals in the sector, the capacity of these agreements to resolve financial commitments ethically and in accordance with the law is examined. The research reveals a notable lack of specific legislation thatexhaustively regulates these agreements, a situation that poses significant challenges for their effective implementation. The need to strengthen the legal framework is identified to ensure that payment agreements not only satisfy basic legal requirements but are also managed under principles of transparency and justice, avoiding corrupt or arbitrary practices. It is argued that adequate and detailed regulation could considerably improve legal certainty and efficiency in public administration. Furthermore, the implications of these agreements on fiscal sustainability and public trust are discussed, suggesting that appropriate management can strengthen governanceand promote transparency in public management.
