La pérdida de la patria potestad en el cantón Ibarra: causas y efectos, 2019-2020

Abstract
En la ciudad de Ibarra se puede evidenciar, dentro de la relación paterno- filial distintos problemas que originan un sin número de situaciones que perjudican, a los niños niñas y adolescentes. Para adentrarnos en el estudio realizado es menester indicar que la patria potestad se define como aquellos derechos y deberes de los padres sobre sus hijos menores. La Constitución y el Código de la niñez protege estos derechos en su mayor expresión, y enviste con el principio del interés superior del niño como aquel derecho subjetivo con carácter prevalente, siendo así una apertura para comprender la necesidad de la Pérdida de la Patria Potestad, ante una falencia de los deberes que ejercen los padres sobre sus hijos. En el presente trabajo se determinará las causales con mayor incidencia al momento de aplicar esta institución jurídica y los efectos causados por la pérdida de la patria potestad en el contexto de la normativa y jurisprudencia ecuatoriana, verificando procesos tramitados dentro de la Unidad de Familia del Cantón Ibarra de los años 2019- 2020, con el fin de determinar cuál de las causales previstas en la norma tienen mayor incidencia en el ejercicio del derecho. Para alcanzar datos que respalden el tema de estudio que manifestamos en líneas anteriores, nos basamos en conocimientos compartidos por cinco jueces de la Unidad Judicial de Familia, Niñez y Adolescencia y Adolescentes Infractores por medio de entrevistas, en donde han expresado a través de su experiencia que es un escenario complejo, nada difícil de recorrer para llegar a una decisión. Y pese a la escasa demanda de procesos presentados, se contempla una gran confusión por parte de los progenitores al momento de presentar una demanda de pérdida de la patria potestad, siendo así motivo de archivar el mismo, por falta de pruebas que respalden la causal invocada.
In Ibarra city, different problems can be seen within the parent-child relationship that cause a number of situations that harm children and adolescents. To delve into the study carried out, it is necessary to indicate that parental authority is defined as those rights and duties of parents over their minor children. The Constitution and the Children's Code protects these rights in their greatest expression, and covers the principle of the best interests of the child as that subjective right with a prevalent nature, thus being an opening to understand the need for the Loss of Parental Power, in the face of a lack of duties that parents exercise over their children. In this work, the causes with the greatest incidence when applying this legal institution and the effects caused by the loss of parental authority will be determined in the context of Ecuadorian regulations and jurisprudence, verifying processes processed within the Family Unit of the Canton. Ibarra for the years 2019-2020, in order to determine which of the causes provided for in the norm have the greatest impact on the exercise of the right. To obtain data that supports the topic of study that we stated in previous lines, we rely on knowledge shared by five judges from the Judicial Unit for Family, Children and Adolescents and Adolescent Offenders through interviews, where they have expressed through their experience which is a complex scenario, not at all difficult to navigate to reach a decision. And despite the low demand for processes presented, there is great confusion on the part of the parents when presenting a claim for loss of parental authority, thus being a reason to archive the same, due to lack of evidence to support the cause invoked.
