Competencia en caso de negativa de inscripción registral de instrumentos públicos. Análisis casuístico en la unidad judicial civil del cantón Ibarra, durante el período 2017-2021

Abstract
La problemática del estudio radica en un conflicto de carácter procedimental y de
competencias en casos donde el Registrador de la Propiedad sienta una razón de negativa
de inscripción, y el usuario afectado no sabe si acudir a instancias registrales o
administrativas creando una disyuntiva de orden procedimental. El objetivo general de este
estudio es determinar la competencia en caso de negativa de inscripción registral de
instrumentos públicos, mediante un análisis casuístico en la Unidad Judicial Civil del
cantón Ibarra, durante el período 2017-2021. Esta investigación es cualitativa con un
enfoque descriptivo donde se utilizó los métodos socio-jurídico y normativista. Por un
lado, se trata de un estudio bibliográfico en el cual se abordan conceptos para entender el
tema, teorías y a partir de sentencias facilitadas se procede a realizar un análisis. Por otro
lado, es una investigación de campo ya que se aplicaron entrevistas a un grupo de actores
clave conformado por seis Registradores de la Propiedad de todos los cantones de la
provincia de Imbabura y un ex Registrador de la Propiedad y actual Director de la
Dirección Nacional de Registro de Datos Públicos (DINARDAP) y a ocho jueces de la
Unidad Judicial Multicompetente Civil del cantón Ibarra. Los resultados obtenidos
evidencian que el Registrador emite un acto registral de carácter civil, más no se trata de
un acto administrativo; además, las negativas de demanda se ventilan bajo el
procedimiento voluntario como lo establece el artículo 334 del Código Orgánico General
de Procesos (COGEP) y la Ley de Registro. Es importante señalar que el Juez de lo Civil
es la autoridad competente para conocer de las negativas de inscripción registral de
instrumentos públicos.
The problem of the study lies in a conflict of procedural nature and competence in cases where the Property Registrar has a reason for refusal of registration, and the affected user does not know whether to go to registry or administrative instances, creating a procedural dilemma. The general objective of this study is to determine the competence in case of refusal of registration of public instruments, through a casuistic analysis in the Civil Judicial Unit of the canton Ibarra, during the period 2017-2021. This research is qualitative with a descriptive approach where the socio-legal and normativism methods were used. On the one hand, it is a bibliographic study in which concepts are addressed to understand the topic, theories and from facilitated sentences we proceed to perform an analysis. On the other hand, it is field research since interviews were applied to a group of key actors formed by six Property Registrars of all the cantons of the province of Imbabura and a former Property Registrar and current Director of the National Directorate of Public Data Registry (DINARDAP) and eight judges of the Civil Multicompetent Judicial Unit of the canton of Ibarra. The results obtained show that the Registrar issues a registry act of a civil nature, but it is not an administrative act; furthermore, the denials of claims are ventilated under the voluntary procedure as established in article 334 of the General Organic Code of Processes (COGEP) and the Registry Law. It is important to point out that the Civil Judge is the competent authority to hear denials of registration of public instruments.
