Abstract
En los últimos años se ha evidenciado el desarrollo de los derechos focalizados de la mujer, impulsando a la igualdad de género y a la no discriminación en el ámbito social y legal, en tal sentido, el trabajo de investigación tuvo como objetivo la aplicación del principio de la no punibilidad de la víctima de trata en el marco legal ecuatoriano, caso medusa en el que se describió los derechos vulnerados referentes al delito de trata de personas mediante el tránsito ilegal de personas, explotación sexual y trabajo forzoso de las víctimas, describiendo el marco de protección de derechos en el Ecuador una vez analizado esto se procedió al análisis de los datos referentes a la trata de personas. La metodología aplicada en esta investigación se realizó desde el enfoque cualitativo, con nivel de profundidad explicativa, con la aplicación de los métodos socio-jurídico, analítico-sintético, por medio de las técnicas de revisión documental, entrevistas y análisis del caso medusa. Teniendo como resultado que el principio de no punibilidad de la víctima se encuentra plasmado en el Código Orgánico Integral Penal, teniendo como sustento el mandato constitucional de protección especial focalizada en la víctima, para el cese y reparación de la vulneración de sus derechos, concluyendo que los derechos vulnerados de las víctimas del delito de trata van desde la pérdida de la libertad y la dignidad humana, su integridad física, psicológica, emocional, explotación y abuso sexual, trabajo forzoso, mendicidad, etc, conforme se evidenció en el caso medusa.
In recent years, the development of focused women's rights has been evidenced, promoting gender equality and non-discrimination in the social and legal sphere, in this sense, the research work had as objective the application of the principle of the non punishability of the victim of trafficking in the Ecuadorian legal framework, the Medusa case in which the violated rights related to the crime of trafficking in persons through the illegal transit of persons, sexual exploitation and forced labor of the victims were described, describing the framework protection of rights in Ecuador, once this was analyzed, the referential data on human trafficking was analyzed. The methodology applied in this research was of a qualitative nature, with a level of explanatory depth, with the application of socio-legal, analytical-synthetic methods, through documentary review techniques, interviews and analysis of the jellyfish case. Having as a result that the principle of non-punishment of the victim is embodied in the Comprehensive Organic Criminal Code, having as support the constitutional mandate of special protection focused on the victim, for the cessation and repair of the violation of their rights, concluding that The violated rights of the victims of the crime of trafficking range from the loss of freedom and human dignity, their physical, psychological, emotional, exploitation and sexual integrity, forced labor, begging, etc., as evidenced in the jellyfish case.
