Abstract
En el cantón San Pedro de Pimampiro existe una gran cantidad de perros que vagan por las calles y van dejando excrementos y orina por todos lados así afectando el derecho que tienen las personas a vivir en un ambiente sano el cual se encuentra contemplado en el artículo 14 de Constitución del Ecuador de 2008 pero por la presencia de estos canes se ve afectada la salud y para controlar la fauna urbana el Gobierno Autónomo Descentralizado de Pimampiro ha instaurado ordenanzas las cuales prohíben que las personas abandonen a sus mascotas en vías públicas, no recoger los excrementos que dejen las mascotas en la vía pública, permitir que los animales salgan del domicilio sin las debidas seguridades, permitir que deambulen sin la debida supervisión de un responsable las cuales por su incumplimiento acarrean una sanción. El objetivo general de esta investigación es analizar las ordenanzas mediante el estudio de sus normas y la observación de la realidad en los espacios públicos donde los animales domésticos hagan presencia, a fin de precisar si la normativa local está cumpliendo con sus fines de resguardar la integridad de los mismos, garantizar el cumplimiento de las obligaciones de los dueños y precautelar los derechos ambientales de las personas. La investigación se apoyó de la técnica de revisión y análisis documental como también de la técnica de observación estructurada lo cual facilitó la realización de esta investigación. De este modo se pudo llegar a la conclusión que a pesar de que existe normativa y su incumplimiento acarrea sanciones estas ordenanzas no se cumplen en el cantón y tampoco existe normativa que resguarde el derecho de las personas a vivir en un ambiente sano.
In the canton of San Pedro de Pimampiro there is a large number of dogs that roam the streets and leave excrement and urine everywhere, thus affecting the right of people to live in an environment that is contemplated in the Constitution of Ecuador. of 2008 but due to the presence of these dogs, health is affected and to control urban fauna, the Decentralized Autonomous Government of Pimampiro has established ordinances which prohibit people from abandoning their pets on public roads, not picking up the excrement left by the pets on public roads, allowing animals to leave the home without proper security, allowing them to roam without proper supervision by a person in charge, which for non-compliance carry a penalty. The general objective of this research is to analyze the ordinances through the study of their regulations and the observation of the reality in public spaces where domestic animals are present, in order to determine if the local regulations are fulfilling their purposes of protecting the integrity of the same, guarantee the fulfillment of the obligations of the owners and safeguard the environmental rights of the people. The research was supported by the documentary review and analysis technique as well as the structured observation technique, which facilitated the carrying out of this investigation. In this way, it was possible to reach the conclusion that despite the fact that there are regulations and their non-compliance carries sanctions, these ordinances are not complied with in the canton and there are no regulations that protect the right of people to live in a healthy environment.
