Abstract
La investigación desarrollada trata sobre el estudio de la tutela de los derechos territoriales
de los pueblos indígenas a través de la acción de protección en el Ecuador, con el propósito
de llegar a aportar conocimientos acerca de esta garantía jurisdiccional como instrumento
jurídico de defensa, desde un argumento que identifica la parte legal distinguiendo la
eficacia y tutelaje de la acción de protección en el actual ordenamiento jurídico. Y por otro
lado se distingue el contexto social y en general la cosmovisión con la posesión del
territorio para entender esta relación y las formas de resistencia que aplican los pueblos
ancestrales.
Por muchos años el Ecuador ha concesionado la exploración y explotación de diversos
territorios a pesar de que es considerado megadiverso y pluricultural, estas concesiones
ponen en indefensión específicamente a los pueblos indígenas ante las intromisiones
externas por parte de las entidades del Estado o por parte de las empresas transnacionales
quienes por lo general pretenden realizar actividades extractivas en dichos territorios sin
previa consulta. Lo que llevó a relacionar el Caso No. 273-19-JP de los A´I Cofán de
Sinangoe del año 2018, con este trabajo investigativo, ya que la revisión del caso nos
permite cumplir con los objetivos y las preguntas de investigación que se persiguen, a
través de la observación del rol que desempeña esta garantía dentro del ordenamiento
ecuatoriano. De esta manera, se examina la postura del Estado frente a las incursiones que
se encargan de extraer y eliminar los recursos naturales del territorio de los pueblos
indígenas.
La investigación se apoya en la revisión y análisis bibliográfico tomando en cuenta el
criterio de varios autores, jurisprudencia vinculante, los instrumentos legales
internacionales, la normativa ecuatoriana y la sentencia del caso. Además, se realizó una
serie de entrevistas estructuradas a profesionales del derecho, a los dirigentes territoriales
indígenas, un miembro defensor de la comunidad A´I Cofán de Sinangoe y el delegado de
la Defensoría del Pueblo del caso, personas que se encuentran relacionadas con el tema
objeto de estudio.
The following rearch deals with the study of the protection of the territorial rights of indigenous people through the action of protection in Ecuador, with the purpose of contribute knowledge about this jurisdictional guarantee as a legal instrument of defense, from an argument that identifies the legal part distinguishing the effectiveness and protection of the action of protection in the current legal system. On the other hand, the social context and in general the cosmovision with the possession of the territory is distinguished in order to understand this relationship and the forms of resistance applied by the ancestral peoples. For many years, Ecuador has granted concessions for the exploration and exploitation of various territories despite the fact that it is considered megadiverse and pluricultural, these concessions put indigenous peoples specifically in defenselessness against external intrusions by State entities or transnational companies who generally intend to carry out extractive activities in these territories without prior consultation. This led to relate Case No. 273-19-JP of the A'I Cofán de Sinangoe of 2018, with this research work, since the review of the case allows us to fullfill and research questions pursued, through the observation of the role played by this guarantee within the Ecuadorian legal system. In this way, we examine the position of the State in the face of incursions that are responsible for extracting and eliminating natural resources from the territory of ethnic groups. The research is based on a bibliographic review and analysis taking into account the criteria of several authors, binding jurisprudence, international legal instruments, Ecuadorian regulations and the sentence of the case. In addition, a series of structured interviews were conducted with legal professionals, indigenous territorial leaders, a defense counsel member of the A'I Cofán de Sinangoe community and the delegate of the Ombudsman's Office in the case, people who are related to the subject under study.
