Abstract
Ecuador en un Estado constitucional de derechos y justicia, así lo manifiesta la Constitución
en su artículo 1, la Constitución ecuatoriana tiene un amplio catálogo de derechos que refiere
tanto a individuos y a colectivos, siendo todos los derechos de igual jerarquía, ninguno
prevalecerá sobre otro, además de que el Estado tendrá la obligación de tutelar y proteger
los derechos de los ciudadanos. En este sentido los Convenios y Tratados Internacionales
también contienen directrices que encaminan al correcto cumplimiento de los derechos
internamente en un Estado. La aplicación del Estado de Excepción mediante un decreto
presidencial, produce efectos jurídicos que pretende limitar derechos ciudadanos, y que su
fin es el de regular el ejercicio de garantías constitucionales con el fin de mantener el orden
público, los mecanismos de conservación del sistema. A través de la historia, se ha mostrado
al Estado de Excepción, como una figura legal justificada, por cuanto, se lo ha hecho como
un mecanismo protector del Estado, del cual forman parte los ciudadanos que a este
pertenecen, es así que al referirse a una situación de emergencia el derecho se lo neutraliza,
y ante una posible amenaza contra dicho Estado, se emite una excepción con fuerza; en este
sentido, es preciso decir que ante la imposición de un régimen supuestamente para combatir
la agresión al Estado, se limitan los derechos de sus conciudadanos, derechos que están en
íntima relación con valores y principios jurídicos y con determinados bienes y valores
fundamentales que exigen protección en todo momento y circunstancia, y con mayor razón
aún, cuando se ven en grave peligro ante situaciones de emergencia excepcional, de crisis
extraordinarias o de conflictos armados.

Throughout history, the State of Exception has been shown as a justified legal figure, because it has been made as a protective mechanism of the State, of which the citizens who belong to it are part, so that when referring to an emergency situation the law is neutralized, and before a possible threat against the State, an exception is issued with force; In this sense, it must be said that before the imposition of a regime supposedly to combat aggression against the State, the rights of its fellow citizens are limited, rights that are intimately related to legal values and principles and to certain fundamental goods and values that require protection at all times and circumstances, and even more so when they are in serious danger in situations of exceptional emergency, extraordinary crisis or armed conflict.
