Abstract
La Constitución de 2008 en Ecuador permite la consulta popular por el pueblo ecuatoriano como mecanismo para pronunciarse frente a temas de interés nacional, así la imprescriptibilidad de los delitos sexuales en los niños, niñas y adolescentes, se considera como una institución jurídica indispensable para reparar el daño causado a las víctimas, sin limitación de tiempo, logrando el fin de la prescripción de la acción penal, conjuntamente con el objeto del proceso penal, la política criminal y delitos sexuales\; para lo cual se seguirá la perspectiva de la doctrina nacional. En este contexto, el objetivo general de esta investigación es analizar la imprescriptibilidad de los delitos sexuales en contra de niños, niñas y adolescentes, con el fin de determinar las incidencias dentro del sistema jurídico ecuatoriano, tanto positivas como negativas, tomando en cuenta que el Estado ecuatoriano es el titular del ius puniendi como principal ente sancionador y punitivo. Tomando en cuenta el método normativista y hermenéutico se analiza la conceptualización de la aplicabilidad de este principio de imprescriptibilidad que, al ser reciente, genera múltiples debates, en base a aspectos normativos que deben determinar su alcance y aplicación frente a las recientes reformas del marco legal nacional. Esta investigación tiene un enfoque de tipo cualitativo y un nivel de profundidad explicativo se precisan las incidencias a favor y en contra de la imprescriptibilidad de los delitos sexuales. A partir de las entrevistas y la revisión doctrinal, se evidencia que la finalidad de la figura jurídica de la imprescriptibilidad de la acción y de la pena en el delito de violación es generar precedentes respecto de la tutela integral de los bienes jurídicos protegidos y, con ello, fortalecer la facultad punitiva del Estado para evitar la impunidad, ya que con los delitos sexuales se protege la integridad sexual y reproductiva de las víctimas.
