Abstract
El presente trabajo de investigación trata sobre El estudio comparativo sobre los beneficios contemplados en la Ley de Fomento Productivo 1 y el Proyecto de Ley de Fomento Productivo 2 del Ecuador, en el cual la base central de esta investigación se centra en identificar los beneficios que pueden dar este tipo de leyes para la reactivación y fortalecimiento económico dentro del país, a través de incentivos tributarios para personas naturales y jurídicas, además de fortalecer las inversiones nacionales con empresas ya existentes y fomentar la creación de nuevas empresas, e inclusive dando la posibilidad de implementarse en el país inversiones extranjeras que aporten al desarrollo productivo del país. La investigación se realizó mediante el estudio cualitativo de tales beneficios para determinar cuál de ambas normativas va a tener mayor impacto en la reactivación y fortalecimiento de la economía del país, para lo cual es necesario: analizar la normativa jurídica establecida en Ecuador, el estudio documental de incentivos tributarios que van enfocadas al Fomento Productivo y estabilización económica que permiten un proceso inductivo e interpretativo con el cual se determina en forma descriptiva los resultados obtenidos, además de integrar la ayuda de las entrevistas para fundamentar esta investigación y poder corroborar los beneficios que existen dentro de la aplicación de estas normativas en el Ecuador. De acuerdo a los incentivos tributarios aplicados en esta clase de leyes se ven beneficiados sectores productivos como MIPYMES, además de verse influenciados sectores de desarrollo social, actividades turísticas e incluso actividades económicas que no han sido tomadas en cuenta por el Estado en otras ocasiones; por lo que se concluyó que estas leyes pueden ser muy beneficiosas para la reactivación, fortalecimiento, estabilidad y equilibrio fiscal dentro de toda la economía de nuestro país, incluyendo en esta empresas privadas y la economía Estatal.
This research work deals with The comparative study on the benefits contemplated in the Productive Development Law 1 and the Productive Development Law Project 2 of Ecuador, in which the central basis of this research focuses on identifying the benefits that can give this type of laws for the reactivation and economic strengthening within the country, through tax incentives for natural and legal persons, in addition to strengthening national investments with existing companies and promoting the creation of new companies, and even giving the possibility of implementing foreign investments in the country that contribute to the productive development of the country. The research was carried out through the qualitative study of such benefits to determine which of both regulations will have the greatest impact on the reactivation and strengthening of the country's economy, for which it is necessary to: analyze the legal regulations established in Ecuador, the documentary study of tax incentives that are focused on Productive Development and economic stabilization that allow an inductive and interpretive process with which the results obtained are determined in a descriptive way, in addition to integrating the help of the interviews to support this research and be able to corroborate the benefits that exist within the application of these regulations in Ecuador. According to the tax incentives applied in this class of laws, productive sectors such as MIPYMES benefit, in addition to being influenced by sectors of social development, tourist activities and even economic activities that have not been taken into account by the State on other occasions; Therefore, it was concluded that these laws can be very beneficial for the reactivation, strengthening, stability and fiscal balance within the entire economy of our country, including private companies and the State economy.
