Abstract
El presente estudio tiene como fundamento analizar los aspectos socio-jurídicos de las deportaciones ejecutadas en el cantón Tulcán provincia del Carchi, considerando el incremento de flujo migratorio de ciudadanos venezolanos hacia el territorio ecuatoriano, este mencionado desplazamiento puede dar lugar para se produzcan un sinnúmero de vulneraciones de los derechos fundamentales, para lo cual, se ha establecido en la Constitución de la República del Ecuador y la Ley Orgánica de Movilidad Humana un catálogo de derechos para los inmigrantes que se encuentren residiendo de forma temporal o permanente dentro de los límites territoriales, para que prevalezcan sus derechos a una vida digna. Los objetivos que se persiguen con el presente estudio, por un lado, es establecer todos los derechos que poseen los inmigrantes en el Ecuador y por otro, verificar la aplicación de la normativa en lo que respecta las deportaciones para determinar si efectivamente la legislación ecuatoriana salvaguarda a los inmigrantes de vulneraciones de derechos fundamentales al momento de su deportación, por último examinar los resultados con la utilización del método socio-jurídico y normativista considerando las diferentes normas internacionales como también normas nacionales, aplicando entrevistas para poder lograr establecer las conclusiones, recomendaciones y de esa forma poder llegar a un claro y preciso entendimiento de las principales causas que originan el flujo migratorio hacia nuestro país, el cual respetando su derecho al libre tránsito los acoge pero por la gran creciente migratoria en alguno de los casos ingresan de debida forma y en su gran mayoría de forma clandestina, nuestra legislación se vio obligada a realizar una reforma a nuestra Ley de Movilidad Humana la cual su principal propósito es establecer los mecanismos adecuados para tratar de solucionar esta problemática y regular, normalizar los procedimientos aplicables para las nueve causales vigentes de deportación siempre respetando el debido proceso y garantizado el efectivo goce de sus derechos.
The present study is based on analyzing the socio-legal aspects of the deportations carried out in the Tulcán canton, Carchi province, considering the increase in the migratory flow of Venezuelan citizens to the Ecuadorian territory, this aforementioned displacement can give rise to countless of violations of fundamental rights, for which, a catalog of rights for immigrants who are residing temporarily or permanently within territorial limits has been established in the Constitution of the Republic of Ecuador and the Organic Law of Human Mobility, so that their rights to a decent life prevail. The objectives pursued with this study, on the one hand, is to establish all the rights that immigrants have in Ecuador and, on the other hand, to verify the application of the regulations regarding deportations to determine if Ecuadorian legislation effectively safeguards to immigrants of violations of fundamental rights at the time of their deportation, finally examine the results with the use of the socio legal and normative method considering the different international norms as well as national norms, applying interviews to be able to establish the conclusions, recommendations and in this way to be able to reach a clear and precise understanding of the main causes that originate the migratory flow to our country, which, respecting their right to free transit, welcomes them but due to the great migratory growth in some of the cases they enter properly and the vast majority clandestinely, our legis The association was forced to carry out a reform to our Human Mobility Law whose main purpose is to establish adequate mechanisms to try to solve this problem and regulate, normalize the applicable procedures for the nine current grounds for deportation, always respecting due process and guaranteed the effective enjoyment of their rights.
