This paper aims to evaluate the judicial referral to mediation as a mechanism for improving justice, just as this issue has a very significant relevance, since its purpose is to provide citizens with the possibility of access to justice, Taking into account that the state is that institution that has the power and the obligation to administer it, such justice is not only resolved through a judicial procedure as socially is believed, there are also different alternatives such as mediation, where problems are solved by taking Account regulatory parameters. For the reasons given above, the improvement of access to justice is palpable as a need not only of Ecuador but of the entire world, a need that can be satisfied by the implementation of public policies in favor of the use of alternative methods of conflict resolution, thus enabling the decongestion of processes that are processed in the Council of the Judiciary, understood as the entity that assumes the administration of ordinary justice in Ecuador.
