Abstract
Adoption is not only a figure or a legal instrument; it is and should be understood as a
protection mechanism for abandoned children and adolescents, the Ecuadorian state must
guarantee the reintegration of this group of priority attention to a family in order to ensure
compliance with the rights established in our Constitution.
In the International Treaties and Conventions that Ecuador has ratified, the State's intention to
protect the human rights of this priority attention group is observed, however the social and
legal reality is far from these ideals since, as it is observed in the Organic Codes that regulate
these adoption processes and also in the Adoption Regulation, the process to be able to adopt
is long and tedious, although it can be understood that it must be ensured that the children
who are going to be adopted achieve family reintegration with a suitable family and with all
the capacities, be they physical, economic and above all psychological affective.
In the present research work, it is intended to analyze the human right that this group of
priority attention has to own a family and the obligation that the Ecuadorian State has to
guarantee all the Girls, Boys and Adolescents an effective, efficient process and above all a
process with speed so that they can have a family and a dignified life as it is established in the
United Nations Convention on the Rights of the Child of 1989.

La adopción no solo es una figura o un instrumento jurídico, es y debe ser entendida como un
mecanismo de protección hacia las niñas, niños y adolescente en situación de abandono, el
estado ecuatoriano debe garantizar la reinserción de este grupo de atención prioritario a una

familia para poder así asegurar el cumplimiento de los derechos establecidos en nuestra
Constitución.
En los Tratados y Convenios Internacionales que el Ecuador ha ratificado se observa la
intención del Estado de precautelar los derechos humanos de este grupo de atención
prioritaria, sin embrago la realidad social y jurídica dista mucho de estos ideales ya que como
se observa en los Códigos Orgánicos que regulan estos procesos de adopción y también en el
Reglamento de Adopción, el proceso para poder adoptar es largo y tedioso, aunque se puede
entender ya que se debe velar que los niños que van a ser adoptados, logren la reinserción
familiar con una familia apta y con todas las capacidades, ya sean estas físicas, económicas y
sobre todo psicológicas afectivas.
En el presente trabajo de investigación, se pretende analizar el derecho humano que tiene este
grupo de atención prioritaria a poseer una familia y la obligación que tiene el estado
ecuatoriano de garantizar a todas las Niñas, Niños y Adolescentes un proceso eficaz, eficiente
y sobre todo un proceso con celeridad para que puedan tener una familia y una vida digna
como lo establece la Convención de Naciones Unidas sobre los Derechos del Niño de 1989.
