Abstract
El presente trabajo investigativo tuvo la finalidad de estudiar de manera descriptiva el
principio de Non Bis In Ídem en aplicación al Pluralismo Jurídico Ecuatoriano, por lo que se
analiza el reconocimiento legal de la justicia indígena en los ordenamientos jurídicos
nacionales, sus características, procedimiento, formas de sanción entendidas desde el punto de
vista consuetudinario y comparándola con la justicia ordinaria, con el fin de llegar a entender
la garantía de la prohibición de doble juzgamiento, cuando una persona ya ha sido juzgada o
procesada de forma previa por la justicia indígena y posterior llega a conocimiento de la
justicia ordinaria, utilizando para el estudio y argumentos, jurisprudencia, resoluciones,
normas jurídicas y doctrina aplicable al estudio del presente artículo, a más de que se realiza
críticas constructivas de los procedimientos y/o conceptos establecidos por los autores, con el
ánimo de aportar y así llegar a tener certeza y conocimiento de la efectividad de la justicia
indígena y la importancia de su reconocimiento al encontrarse sujeta al control constitucional,
así como también la aplicación de la garantía del Non Bis In Ídem en el Pluralismo Jurídico.
The present investigative work had the purpose of studying in a descriptive way the principle of Non Bis In Idem in application to the Ecuadorian Legal Pluralism, for what is analyzed the 2 legal recognition of the indigenous justice in the national legal systems, its characteristics, procedure, forms of sanction understood from the customary point of view and comparing it with the ordinary justice, with the purpose of getting to understand the guarantee of the prohibition of double judgment, when a person has already been judged or processed before by the indigenous justice and later it comes to knowledge of ordinary justice, using for the study and arguments, jurisprudence, resolutions, legal norms and doctrine applicable to the study of this article, in addition to constructive criticism of the procedures and / or concepts established by the authors, with the aim of contributing and thus reaching certainty and knowledge of the effectiveness of indigenous justice and the importance of its recognition to be subject to constitutional control, as well as the application of the guarantee of Non Bis In Idem in Legal Pluralism.
