The present research analyzes the relationship between international cooperation and national sovereignty and its impact by examining the Agreement on the Status of Forces on Ecuadorian sovereignty from a constitutional perspective. This agreement, signed in 2023 and ratified in 2024, grants privileges to U.S. military and civilian personnel, as well as contractors, including the transfer of criminal jurisdiction, tax exemptions, and unrestricted use of the radio spectrum. Although initially aimed at strengthening the fight against transnational organized crime, these provisions have sparked controversy for potentially infringing on national sovereignty. The research, using a qualitative method and a documentary design, analyzes the concepts of sovereignty” and international cooperation,” emphasizing that sovereignty has evolved from an absolute power of the state to a dynamic concept that must balance autonomy and cooperation in an increasingly globalized world. Through the establishment of a jurisprudential line on the matter and the analysis of Opinion 10-23-TI/24 of the Constitutional Court of Ecuador, it was identified that there is argumentative consistency in the reviewed rulings, despite dissenting opinions that accompanied the decisions demonstrating discrepancies with the arguments of the Plenary. These dissenting votes highlighted significant risks to territorial sovereignty, especially due to the transfer of criminal jurisdiction to the United States and unrestricted access to Ecuadorian resources. The study concludes that, while international cooperation is essential to address threats such as drug trafficking, it must align with constitutional principles to avoid disproportionate concessions and the subjugation of a small state to the interests of global powers. Thus, this work provides a foundation for understanding and balancing the relationship between sovereignty and international cooperation, emphasizing the importance of preserving state autonomy while addressing the challenges of a globalized environment.
