Abstract
Es claro que el Estado Constitucional consagra derechos fundamentales. Pero del mismo modo, esos derechos no sirven de nada, son letra muerta sino poseen un sistema procesal que los garanticen de manera oportuna, real y eficiente. Más allá de los derechos fundamentales tradicionales, existen otros derechos, también fundamentales, más técnicos como la seguridad jurídica o la tutela jurídica, la Supremacía Constitucional, considerada desde antiguo como sistema técnico-legislativo, y lo que proponemos es que sea hoy considerada como un derecho fundamental y, de esta manera, otros derechos de igual tecnicismo puedan ser una realidad como la seguridad jurídica, la tutela judicial efectiva, el acceso a la justicia. Los distintos sistemas de control constitucional, son mecanismos de aseguramiento de la supremacía constitucional, pero deben ser verdaderos garantes de la misma pero considerada como derecho fundamental. En el Ecuador, a más de tener un muy típico y novedoso sistema de control de constitucionalidad, se ha dado origen, a partir de 2008 del denominado Auto Control Constitucional, por el cual, la técnica del control de constitucionalidad va más allá del papel de jueces y autoridades administrativas, para ser desarrollado por todo tipo de estructuras políticas como el mismo Legislativo y hasta por la ciudadanía en general.
It is clear that the Constitutional State enshrines fundamental rights. But in the same way, these rights are of no use, they are dead letter but have a procedural system that guarantees them in a timely, real and efficient manner. Beyond traditional fundamental rights, there are other rights, also fundamental, more technical such as legal certainty or legal protection, Constitutional Supremacy, considered from the old as a technical-legislative system, and what we propose is that today it is considered as a fundamental right and, in this way, other rights of equal technicality can be a reality such as legal certainty, effective judicial protection, access to justice. The different systems of constitutional control, are mechanisms of assurance of the constitutional supremacy, but they must be true guarantors of the same but considered as fundamental right. In Ecuador, in addition to having a very typical and novel system of control of constitutionality, since 2008 has been called the Auto Constitutional Control, by which, the technique of control of constitutionality goes beyond the role of judges and administrative authorities, to be developed by all types of political structures such as the Legislative itself and even by the general public.
