Protección legal de los derechos de autor de los músicos en Ecuador: Perspectivas en la era digital

Abstract
El presente estudio analiza la protección de los derechos de autor de los músicos ecuatorianos en el entorno digital, evaluando la eficacia de la normativa nacional e internacional vigente, a partir de la formulación de las siguientes preguntas de investigación: ¿Cómo están protegidos los derechos de los autores de obras musicales en Ecuador ante el auge y desarrollo de las redes sociales y nuevas plataformas digitales? ¿Cuáles son los desafíos y oportunidades que presentan las plataformas digitales en este contexto? Con un enfoque cualitativo y una profundidad descriptiva, se aplicaron los métodos analítico sintético y socio jurídico, así como la técnica de revisión documental y la entrevista estructurada. Entre los principales desafíos identificados destacan la insuficiencia en la educación sobre derechos de autor, los excesivos procesos burocráticos en los registros, la piratería, la falta de una gestión eficiente de los derechos digitales y la falta de interés en afiliarse al SAYCE debido a los cuestionamientos sobre su transparencia y efectividad. Con la investigación se evidenció que, aunque Ecuador cuenta con un marco legal sólido liderado por la Constitución y el Código Orgánico de la Economía Social de los Conocimientos, la implementación de estas normativas presenta limitaciones significativas que afectan su eficacia. Así mismo se identificó la importancia de diseñar campañas educativas dirigidas a músicos y público en general, así como la necesidad de profundizar la cooperación internacional para armonizar normativas adaptadas a los retos de la era digital e incorporar tecnologías emergentes para mejorar la trazabilidad y gestión de regalías. Se concluyó que el fortalecimiento de la eficacia del marco normativo vigente es fundamental para proteger los derechos de los autores, impulsar el desarrollo de la industria musical y promover un crecimiento cultural y económico sostenible en el país.
This study analyzes the protection of copyright rights for Ecuadorian musicians in the digital environment, evaluating the effectiveness of current national and international regulations through the formulation of the following research questions: How are the rights of authors of musical works protected in Ecuador in light of the rise and development of social media and new digital platforms? What challenges and opportunities do digital platforms present in this context? Using a qualitative approach and descriptive depth, the analytical-synthetic and socio-legal methods were applied, along with documentary review and structured interviews. Key challenges identified include insufficient education on copyright, excessive bureaucratic processes in registrations, piracy, lack of efficient management of digital rights, and disinterest in joining SAYCE due to concerns about its transparency and effectiveness. The research revealed that although Ecuador has a solid legal framework led by the Constitution and the Organic Code of the Social Economy of Knowledge, the implementation of these regulations faces significant limitations that affect their effectiveness. Additionally, the importance of designing educational campaigns aimed at musicians and the general public was identified, as well as the need to deepen international cooperation to harmonize regulations adapted to the challenges of the digital era and incorporate emerging technologies to improve traceability and royalty management. It was concluded that strengthening the effectiveness of the current regulatory framework is essential to protect authors' rights, promote the development of the music industry, and foster sustainable cultural and economic growth in the country.
