Abstract
La presente investigación tiene como objetivo analizar el cumplimiento y eficacia de la ordenanza de manejo de residuos sólidos de Montufar, provincia del Carchi, en el periodo 2021-2022, misma que lleva por nombre La Ordenanza para el manejo integral de residuos sólidos y desechos líquidos (aceites de cocina) en el cantón Montufar. Partiendo de la interrogante: ¿Se da cumplimiento a la ordenanza de manejo integral de residuos sólidos emitida por el Cantón Montúfar? El método empleado es el socio-jurídico el cual permitió determinar el cumplimiento de la ordenanza en estudio y la realidad social en torno a su cumplimiento, se emplearon las técnicas de análisis documental y entrevistas a determinadas persona abarcando a funcionarios del Gobierno Autónomo Descentralizado Municipal de Montufar (en adelante GAD Municipal de Montufar), a miembros de la Asociación de Recolectores y a ciudadanos. Obteniendo como resultado que no hay un cumplimiento eficaz en torno a la aplicación de la ordenanza, considerando el desconocimiento de la misma por parte de la ciudadanía, y débil aplicación de sanciones.
The objective of this research is to analyze the compliance and effectiveness of the solid waste management ordinance of Montufar, Carchi Province, in the period 2021-2022, which is called Ordinance for the integrated management of solid waste and liquid waste (cooking oils) in the canton of Montufar. Starting from the question: Is the ordinance for the integrated management of solid waste issued by the Montufar Canton being complied with? The method used was the socio-legal one, which allowed determining the compliance with the ordinance under study and the social reality regarding its compliance, using documentary analysis techniques and interviews with certain people, including officials of the Municipal Government of Montufar, members of the Association of Collectors and citizens. The result was that there is no effective enforcement of the ordinance, considering the lack of knowledge on the part of citizens, and weak application of sanctions.
