Abstract
Este trabajo centró su interés en la actual situación ambiental de la Laguna de Yahuarcocha, una microcuenca ubicada en el cantón Ibarra, identificando la problemática de ausencia de Políticas Públicas exclusivas para el manejo de las aguas servidas y de los desechos sólidos, crecimiento urbano y la actividad turística. De allí que sea relevante evaluar tanto la eficacia de las políticas públicas diseñadas por la autoridad competente, como el cumplimiento de su correspondiente régimen jurídico. En este sentido, el objetivo de esta investigación fue evaluar la eficacia de las políticas públicas diseñadas y aplicadas en el sector de Laguna de Yahuarcocha, tanto por el Gobierno Autónomo Descentralizado del cantón Ibarra, como por el Ministerio del Ambiente, Agua y Transición Ecológica, mediante el estudio de su régimen jurídico y de su Plan de manejo integral, con el fin de conocer su situación actual y hacer algunas sugerencias. El enfoque de la investigación fue cualitativo y su nivel de profundidad fue descriptivo. Los métodos utilizados fueron el socio jurídico y el método analítico. Alcanzando como resultado que la responsabilidad de proteger la naturaleza recae principalmente en el Estado y la sociedad, teniendo competencia principal de toda la gestión ambiental con el Sistema Nacional Descentralizado de Gestión Ambiental, en coordinación con los Gobiernos Autónomos Descentralizados. Concluyendo en que no se cuenta con políticas públicas exclusivas para actuar frente al estado actual de la Laguna, sin embargo, con las Ordenanzas existentes se ha logrado la disminución de poblaciones de cianobacterias, evaluando también la disminución de ficocianina que es el pigmento de las cianobacterias.
This work focused its interest on the current environmental situation of the Yahuarcocha Lagoon, a micro-basin located in the Ibarra canton, identifying the problem of the absence of exclusive Public Policies for the management of sewage and solid waste, urban growth and the tourist activity. Hence, it is relevant to evaluate both the effectiveness of public policies designed by the competent authority, as well as compliance with their corresponding legal regime. In this sense, the objective of this research was to evaluate the effectiveness of public policies designed and applied in the Laguna de Yahuarcocha sector, both by the Decentralized Autonomous Government of the Ibarra canton, and by the Ministry of the Environment, Water and Ecological Transition, by studying its legal regime and its Comprehensive Management Plan, in order to know its current situation and make some suggestions. The research approach was qualitative and its level of depth was descriptive. The methods used were the legal partner and the analytical method. As a result, the responsibility for protecting nature falls mainly on the State and society, having main responsibility for all environmental management with the National Decentralized Environmental Management System, in coordination with the Decentralized Autonomous Governments. Concluding that there are no exclusive public policies to act against the current state of the Lagoon, however, with the existing Ordinances the decrease in cyanobacteria populations has been achieved, also evaluating the decrease in phycocyanin, which is the pigment of cyanobacteria.
