Abstract
La presente investigación es un estudio socio jurídico sobre la necesidad y conveniencia de incorporar la figura jurídica de la tenencia compartida voluntaria en la normativa ecuatoriana,se observa una carencia notable con relación acerca de las modificaciones en el ámbito del Derecho de Familia. Se propone una posible incorporación específica en cuanto a la tenencia compartida voluntaria, la cual implica que ambos padres cuenten con derechos y responsabilidades equitativas en la toma de decisiones cruciales sobre la vida de sus hijos, abarcando aspectos como educación, salud y actividades extracurriculares. El presente estudio aborda diferentes perspectivas tomadas de reconocidas fuentes bibliográficas, revistas científicas, etc, también aborda criterios doctrinarios de personas especialistas en elámbito Derecho de Familia, también cuenta con encuestas direccionadas a fortalecer de forma eficaz este estudio, lo que se propone buscar es, la participación activa de ambos progenitores en el cuidado diario de los niños, asegurando un entorno familiar estable y enriquecedor para el desarrollo de los menores. En términos generales, la implementación dela tenencia compartida voluntaria en Ecuador busca favorecer el bienestar emocional y psicológico de los hijos al mantener una relación cercana y continua con ambos padres, siempre y cuando sea en el mejor interés de los niños. Es esencial que este tipo de acuerdo seestablezca de manera voluntaria y con el consentimiento de ambas partes.
This socio-legal study explores the necessity and suitability of integrating the legal framework of voluntary shared custody into Ecuadorian legislation, identifying a significantgap concerning modifications within the realm of Family Law. It advocates for a specific incorporation of voluntary shared custody, wherein both parents hold equitable rights and responsibilities in making crucial decisions regarding their children's lives, including education, health, and extracurricular activities. Drawing upon diverse perspectives from reputable bibliographic sources, scientific journals, and doctrinal criteria provided by specialists in Family Law, supplemented by targeted surveys, the study aims to enhance its efficacy. The primary objective is to promote the active participation of both parents in the daily care of their children, ensuring a stable and nurturing family environment conducive to the minors' development. Overall, the implementation of voluntary shared custody in Ecuador seeks to foster the emotional and psychological well-being of children through maintaining close and continuous relationships with both parents, provided it serves the children's best interests. It is imperative that such agreements be established voluntarily andwith the consent of both parties.
