Abstract
La maternidad subrogada, es una técnica de maternidad humana asistida utilizada por miles de personas alrededor del mundo para cumplir sus deseos de ampliar la familia, es así que, muchos países han optado por la implementación favorable de esta técnica en la legislación, con la intención de establecer parámetros, requisitos, derechos y deberes los involucrados, con la finalidad de garantizar que esta técnica sea beneficiosa en la vida de las personas que han optado por utilizarla. La importancia de esta investigación radica en analizar a la maternidad subrogada como una técnica de maternidad humana asistida orientada a garantizar el derecho a la salud reproductiva. El objetivo general de esta investigación fue identificar los derechos protegidos de los niños y niñas desde la concepción para la maternidad subrogada, mediante la revisión de normativa nacional e internacional, análisis de sentencias y la observación directa, con el fin de determinar su aplicabilidad legal en el Ecuador. En la investigación se utilizó un enfoque cualitativo, conjuntamente con el método antropo jurídico y analítico, mientras que las técnicas empleadas fueron la revisión documental, observación directa y revisión de sentencias. A través de doctrina, criterios emitidos por organizaciones internacionales, legislación internacional y sentencias de diferentes sistemas de protección de derechos humanos en cuanto a la maternidad subrogada, la investigación tuvo como resultado la recopilación de aquellos derechos que se garantizan a los niños y niñas desde la concepción, tanto en Ecuador como internacionalmente. La conclusión que se obtuvo fue que, a nivel mundial se busca la protección del Interés Superior del Niño y la toma de decisiones se ejerce en base a la protección de derechos de los mismos.
Surrogacy is an assisted human motherhood technique used by thousands of people around the world to fulfill their desires to expand their family. Thus, many countries have opted for the favorable implementation of this technique in legislation, with the intention to establish parameters, requirements, rights and duties of those involved, in order to guarantee that this technique is beneficial and contributes positively to the lives of the people who have chosen to use it. The importance of this research lies in analyzing surrogacy as an assisted human maternity technique aimed at guaranteeing the right to reproductive health. The general objective of this research was to identify the protected rights of children from conception for surrogacy, through the review of national and international regulations, analysis of sentences and direct observation, in order to determine their legal applicability in the equator. The research used a qualitative approach, together with the anthropo-legal and analytical method, while the techniques used were documentary review, direct observation and review of sentences. Through doctrine, criteria issued by international organizations, international legislation and sentences from different human rights protection systems regarding the regulation of surrogacy, the research resulted in the compilation of those rights that are guaranteed to boys and girls. since conception, both in Ecuador and internationally. The conclusion obtained was that, at a global level, the protection of the Best Interest of the Child is sought and decision-making is exercised based on the protection of their rights.
