Abstract
El presente estudio se centró en investigar la efectividad del adelantamiento de la barrera de protección en infracciones de tránsito en Ibarra durante el año 2022. Con el objetivo general de analizar la aplicación y efectividad del principio legal en los casos de conducción en estado de ebriedad y exceso. de velocidad. La metodología utilizada fue mixta, cuantitativa para el análisis de datos numéricos de infracciones y accidentes que validan la influencia del adelantamiento de la barrera protectora y cualitativa para el análisis de la documentación relevante y descripción de los casos de intoxicación. y exceso de velocidad. Como método de investigación se aplicó el método normativista, el cual permitió indagar en las diferentes normativas relacionadas con el tema de estudio. Por lo tanto, la técnica utilizada fue la revisión documental de jurisprudencia, ya que se investigaron los casos que cuentan con sentencias judiciales registradas en la Unidad Provincial de Estudios Jurimétricos y Estadística, desarrollándose el instrumento del registro observacional en el que se describe detalladamente. las principales características para la identificación de procesos relacionados con el avance de barreras de protección. Se analizaron en Ibarra 8 casos de ebriedad y 11 de exceso de velocidad en 2022; No se realizó muestreo debido a la eliminación de radares. De esta manera se analizan los casos judiciales y disposiciones legales del Código Orgánico Integral Penal. Los resultados reflejaron la correlación entre la aplicación y aplicación constante de barreras protectoras y la reducción de incidentes viales. En conclusión, se destaca la importancia de implementar protocolos claros y capacitación para fortalecer la comprensión y aplicación efectiva del marco legal. Se recomienda establecer un sistema de seguimiento continuo para evaluar la eficacia de los mecanismos de protección establecidos.

The methodology used was a mixed approach, quantitative for the analysis of numerical data of infractions and accidents validating the influence of overtaking the protective barrier and qualitative for the analysis of the relevant documentation and description of the cases of intoxication. and speeding. Therefore, the technique used was a documentary review of jurisprudence, since the cases that have judicial rulings registered in the Provincial Unit of Jurimetric Studies and Statistics were investigated, developing the instrument of the observational record in which it is described in detail. the main characteristics for the identification of processes related to the advancement of protection barriers. 8 cases of drunkenness and 11 of speeding were analyzed in Ibarra in 2022; sampling was not carried out due to the elimination of radars. In this way, the judicial cases and legal provisions of the Comprehensive Organic Penal Code are analyzed. The results reflected the correlation between the consistent application and application of protective barriers and the reduction of road incidents. In conclusion, the importance of implementing clear protocols and training to strengthen the understanding and effective application of the legal framework is highlighted. It is recommended to establish a continuous monitoring system to evaluate the effectiveness of the established protection mechanisms.
