Abstract
La problemática de estudio radica en la inscripción del nacimiento de hijos de adolescentesmigrantes en Ecuador que será analizado a partir de la Sentencia de la Corte ConstitucionalNo. 2185-19-JP, con el objetivo de determinar su impacto, a través de la identificación de los derechos vulnerados ante la negativa de inscripción de nacimiento de hijas e hijos de adolescentes migrantes, para conocer las medidas de reparación integral aplicables al caso, a través del método socio-jurídico, el método inductivo y el método analítico sintético. Se han desarrollado tres resultados en base a los tres objetivos específicos planteados. En primer lugar, de la identificación de normativa, doctrina y jurisprudencia se evidenció que la legislación ecuatoriana coincide con los instrumentos internacionales en cuanto a garantismode derechos, sin embargo, existen cuerpos legales que no han sido actualizados, llegando a contraponerse con la misma Constitución. En segundo lugar, del análisis de cifras de inscripciones de nacimiento de hijos de adolescentes, se observó que la variación de cifras de inscripción de nacimiento de niños y niñas, hijas e hijos de padres adolescentes migrantesen el periodo 2019-2022 no ha sido significativa, por ende, no existe mayor incidencia, porúltimo, el tercer resultado plantea que las medidas de reparación integral emitidas por la Corte Constitucional son eficaces, sin embargo, las instituciones tienen un trámite sumamente burocrático que no permite que estas sean cumplidas a cabalidad y dentro de losplazos establecidos. En este proceso se contó con el aporte a través de criterios expuestos mediante entrevistas de expertos en familia, constitucional, movilidad humana y género, así como de miembros de la Dirección General de Registro Civil, Identificación y Cedulación que permitieron abordar la temática desde distintas aristas.
The focus of the study revolves around the registration of the births of children born to adolescent migrants in Ecuador, to be analyzed in light of Constitutional Court Judgment No. 2185-19-JP. The objective is to determine its impact by identifying the infringed rightsin the denial of birth registration for daughters and sons of adolescent migrants. This aims to inform about the comprehensive reparative measures applicable to the case through socio- legal, inductive, and synthetic analytical methods. Three outcomes have been developed based on the three specified objectives. Firstly, regarding the identification of norms, doctrines, and jurisprudence, it was evident that Ecuadorian legislation aligns with international instruments in terms of rights protection. Nevertheless, there are legal frameworks that have not been updated, leading to conflicts with the Constitution itself. Secondly, from the analysis of birth registration figures for children of adolescent parents, itwas observed that the variation in registration numbers for children of migrant adolescent parents during the period 2019-2022 has not been significant, indicating the low frequency. Lastly, the third outcome suggests that the comprehensive reparative measures issued by theConstitutional Court are effective. However, bureaucratic procedures within institutions hinder their complete fulfilment within the established timelines. In this process, insights from experts in family law, constitutional law, human mobility, and gender were obtained through interviews. Additionally, contributions from members of the General Directorate ofCivil Registry, Identification, and Citizenship facilitated a multifaceted approach to the subject.
