Abstract
El uso ilegítimo de marcas en Ecuador, especialmente entre 2020 y 2023, presenta un desafío del Derecho de propiedad intelectual, con un enfoque particular en la propiedad industrial y los signos distintivos. Esta problemática impacta negativamente en la dinámica comercial y disminuye la confianza del consumidor. Esta investigación se enfoca en identificar las causas y consecuencias de esta práctica, y en desarrollar estrategias legales para su prevención y erradicación. Se resalta la importancia de proteger las marcas, fundamentales para la integridad del mercado, el estudio se realizó con un enfoque cualitativo, permitiendo un análisis detallado de casos concretos y de la legislación pertinente a nivel nacional e internacional. Se aplicaron métodos normativistas para evaluar las leyes vigentes, un método sintético para consolidar información diversa y un método analítico para examinar la legislación y los casos judiciales en detalle. Además, se incluyeron revisiones documentales y entrevistas con propietarios de marcas, proporcionando una visión integral de la situación, los resultados revelan que las infracciones a menudo se deben al desconocimiento sobre el registro y uso correcto de las marcas, así como a violaciones intencionales de derechos de propiedad intelectual. Se observó que, si bien la legislación ecuatoriana es coherente en teoría, enfrenta desafíos en su aplicación práctica, especialmente en términos de celeridad procesal, se propusieron estrategias y recomendaciones para fortalecer la protección legal de la propiedad intelectual en Ecuador. Estas incluyen la actualización y clarificación de las leyes, la capacitación de autoridades para una aplicación más eficiente, la participación acuerdos internacionales, y el uso de tecnologías para detectar y prevenir eficazmente las infracciones. La investigación señala la urgente necesidad de implementar estas medidas para garantizar un entorno comercial justo y respetuoso con la propiedad intelectual., necesito agregar que está enfocado en la propiedad industrial, signos distintivos.
The illicit use of trademarks in Ecuador, especially between 2020 and 2023, poses a significant challenge to intellectual property rights, with a specific focus on industrial property and distinctive signs. This issue adversely affects the commercial dynamics and decreases consumer confidence. This research aims to identify the causes and consequences of this practice and to develop legal strategies for its prevention and eradication. It highlights the importance of protecting trademarks, which are fundamental for market integrity. The study was conducted with a qualitative approach, allowing for a detailed analysis of specific cases and relevant legislation at both national and international levels. Normativist methods were applied to assess current laws, a synthetic method to consolidate diverse information, and an analytical method to examine legislation and judicial cases in detail. Additionally, document reviews and interviews with trademark owners were included, providing a comprehensive view of the situation. The findings reveal that infringements often result from a lack of knowledge about the correct registration and use of trademarks, as well as intentional violations of intellectual property rights. While Ecuadorian legislation is theoretically consistent, it faces challenges in practical application, especially in terms of procedural speed. Strategies and recommendations were proposed to strengthen the legal protection of intellectual property in Ecuador. These include updating and clarifying laws, training authorities for more efficient enforcement, participating in international agreements, and using technologies to effectively detect and prevent infringements. The research underscores the urgent need to implement these measures to ensure a fair and respectful commercial environment for intellectual property, emphasizing the critical importance of protecting industrial property and distinctive signs for economic development and consumer confidence in Ecuador.
