Abstract
El presente proyecto de investigación se titula Análisis al Principio Parental en la ciudad de
Ibarra en el año 2019. Este principio, también es denominado en la doctrina, en la
jurisprudencia y en la normativa como Corresponsabilidad Parental y se encuentra consagrado
en el art. 100 del Código de la Niñez y Adolescencia. Para este trabajo, se ha tomado a la
custodia compartida como punto de partida, siendo así una opción positiva para que ambos
progenitores cumplan en igualdad de condiciones, el deber jurídico de convivencia y cuidado
del menor, lo que, en la literatura actual, se establece como una alternativa más beneficiosa para
el Interés Superior del Niño que la custodia exclusiva. Con base a esto se tiene como objetivo
general proponer la Custodia Compartida como un principio eficaz alternativo dentro de la
Legislación Ecuatoriana, tomando en cuenta la relevancia del Principio Constitucional del
Interés Superior de los niños, niñas y adolescentes, y del Principio Parental; para ello se han
planteado tres objetivos específicos que son: a) Describir el status jurídico de la custodia
monoparental y compartida a nivel internacional y nacional y su relación con otros principios y
derechos en materia de Niñez y Adolescencia; b) Identificar los posibles problemas jurídicos y
de otra índole derivados de la custodia monoparental; y, c) Determinar si la custodia compartida
podría ser una alternativa viable para solucionar los problemas jurídicos derivados de la custodia
monoparental. Para dar respuesta a estos objetivos se aplicaron las técnicas de análisis
documental y la entrevista, siendo la primera, para revisar sentencia de Inconstitucionalidad del
artículo 106 del Código de la Niñez y Adolescencia No. 28-15- IN/21 y la segunda, para
determinar si la custodia compartida vendría a ser una solución a dichos problemas, obteniendo
como principal resultado, que la custodia compartida sí es una solución adecuada, en tanto que
fortalece el principio de corresponsabilidad parental, evita las peleas entre progenitores que
afectan psicológicamente al niño; y disminuyen la continuidad de los estereotipos de género
respecto a los roles de padre y madre.
The former research project is entitled Analysis of the Parental Principle in the city of Ibarra in 2019. This principle is also referred to in doctrine, jurisprudence and regulations as Parental Responsibility and is enshrined in art. 100 of the Code on Children and Adolescents. For this work, shared custody has been taken as a starting point, thus being a positive option for both parents to fulfill on equal terms the legal duty of coexistence and care of the child, what in the current literature, is established as an alternative more beneficial to the Best Interests of the Child than sole custody. Based on this, the general objective is to propose the Shared Custody as an effective alternative principle within Ecuadorian law, taking into account the relevance of the Constitutional Principle of the Best Interest of Children and Adolescents, and the Parental Principle; to this end, three specific objectives have been set: a) To describe the legal status of single and shared custody at the international and national levels and its relationship with other principles and rights relating to children and adolescents; b) Identify possible legal and other problems arising from single-parent custody; and, c) Determine whether joint custody could be a viable alternative for solving legal problems arising from single-parent custody. In order to respond to these objectives, documentary analysis techniques were used and the interview, the first being to review article 106 of the Code on Children and Adolescents No. 28-15-IN/21, and to determine whether joint custody would be a solution to these problems, the main result being that shared custody is an appropriate solution, while it strengthens the principle of parental co responsibility and avoids disputes between parents which affect the child psychologically; and diminish the continuity of gender stereotypes regarding the roles of father and mother.
