Abstract
La presente investigación trata sobre El estudio de la consulta ambiental establecida en el
artículo 398 de la Constitución de la República del Ecuador en la sentencia N° 2018-00640
emitida por la Corte Provincial de Justicia de Imbabura: Caso Bosque Protector Los Cedros, la
cual se realizó con la finalidad de aportar conocimiento sobre la participación ciudadana
ambiental en el Ecuador, resaltando el rol que tiene la ciudadanía cuando el Estado lleva a cabo
actividades que pueden afectar tanto los derechos de la naturaleza como el derecho de las
personas a vivir en un ambiente sano y ecológicamente equilibrado. Siendo así, el objetivo de
la investigación fue analizar el derecho a la consulta ambiental, a través de la revisión y análisis
bibliográfico de autores y normativa nacional e internacional, relacionados con el tema de
estudio, para lo cual, se utilizó los métodos de investigación: lógico deductivo, analítico y
normativista, los cuales permitieron determinar que, la consulta ambiental surge con la
necesidad de proteger a la naturaleza ante la crisis ecológica actual, y se constituye como un
derecho que debe ser garantizado por el Estado. Además, el estudio se apoyó en el método
hermenéutico con el propósito de analizar la sentencia emitida por la Corte Provincial de Justicia
de Imbabura, dentro del Caso Bosque Protector Los Cedros, y una serie de entrevistas dirigidas
a los jueces que conformaron el Tribunal que resolvió el caso y al Representante Jurídico del
Ministerio del Ambiente; de esta manera, se ha llegado a concluir que, el derecho a la consulta
ambiental, como parte del derecho a la participación ciudadana, se encuentra en un constante
proceso de evolución, por lo que actualmente no existen normas claras y precisas sobre el tema,
y, en consecuencia, se vuelve necesario desarrollar una guía que contenga los principios
generales, las políticas y mecanismos que deben regir para la consulta ambiental.
This research deals with The study of the environmental consultation established in article 398 of the Constitution of the Republic of Ecuador in judgment No. 2018-00640 issued by the Provincial Court of Justice of Imbabura: Case of Bosque Protector Los Cedros, which was carried out in order to provide knowledge about environmental citizen participation in Ecuador, highlighting the role that citizens have when the State carries out activities that can affect both the rights of nature and the right of people to live. in a healthy and ecologically balanced environment. Thus, the objective of the research was to analyze the right to environmental consultation, through the review and bibliographic analysis of authors and national and international regulations, related to the subject of study, for which, the research methods were used : logical deductive, analytical and normative, which allowed to determine that the environmental consultation arises with the need to protect nature from the current ecological crisis, and is constituted as a right that must be guaranteed by the State. In addition, the study relied on the hermeneutical method in order to analyze the sentence issued by the Provincial Court of Justice of Imbabura, within the Case of the Bosque Protector Los Cedros, and a series of interviews directed to the judges who made up the Court that decided the case and the Legal Representative of the Ministry of the Environment; In this way, it has been concluded that the right to environmental consultation, as part of the right to citizen participation, is in a constant process of evolution, so there are currently no clear and precise regulations on the subject. Thus, it is necessary to develop a guide that contains the general principles, policies and mechanisms that should govern for environmental consultation.
