Abstract
El presente trabajo de investigación se estableció en realizar el Análisis Jurídico del Uso Progresivo de la Fuerza Ejercida por parte de la Policía Nacional: Caso Mascarilla, puesto que es importante conocer sobre la normativa que regula el Uso Progresivo de la Fuerza y sobre los criterios observados para determinar si se inobservó o no el uso progresivo de la fuerza en el caso Nro. 10281-2018-01513. Para el desarrollo de esta investigación se llevó a cabo el análisis normativo que regula el Uso Progresivo de la Fuerza, siendo el Código de Conducta para funcionarios encargados de hacer cumplir la Ley, los Principios básicos del empleo de la fuerza y armas de fuego para los funcionarios encargados de ser cumplir la ley, y el Reglamento de uso legal adecuado y proporcionado de la fuerza para la Policía Nacional del Ecuador, además como técnica se realizó el análisis documental de la sentencia del caso indicado, y la entrevista que se realizó al fiscal titular de la causa, abogados en libre ejercicio y a Policiales que también son abogados, es decir la entrevista se realizó a profesionales que conocen del derecho, en donde se pudo verificar y establecer claramente la normativa internacional y Nacional que regula al Uso Progresivo de la Fuerza, como también se determinó los criterios para una adecuada aplicación del uso progresivo de la fuerza en la jurisprudencia internacional y en base al análisis de los elementos constitutivos del tipo penal se logró verificar que la conducta del Cbop. David Velastegui se encuentra adecuada al tipo penal de extralimitación en la ejecución de un acto de servicio.

David Velastegui is suitable for the criminal type of overreach in the execution of an act of service.
