Abstract
La prueba para mejor resolver o prueba ex officium dentro del nuevo esquema constitucional y procesal orgánico que se ha implementado en el Ecuador, con la entrada en vigor del Código Orgánico General de Procesos brindando una expectativa de un cambio radical en la actitud de los intervinientes en la actividad judicial y, con ello, lo que se espera es que los jueces tengan una actividad más participativa dentro del proceso. El Código Orgánico de la Función Judicial siguiendo esta línea constitucional aumenta los poderes y facultades del juez, siendo una de estas potestades la de ordenar la práctica de pruebas para mejor resolver, cuestión que no ha estado exenta de polémica, ya que algunos tratadistas señalan que a través de este mecanismo se mejora la prueba de la parte procesal que actúa con negligencia. Siendo el objetivo general de esta investigación analizar la eficacia jurídica de la prueba de oficio contenida en el COGEP y su legalidad en relación al principio de imparcialidad en procesos de la familia, de pensión alimenticia en el año 2020, en el cantón Ibarra, se recurre al enfoque cualitativo, con un nivel de profundidad descriptivo debido a que se procede a detallar el estado de la investigación y la eficacia de la prueba judicial, lo que lleva a la aplicación del método deductivo y el método hermenéutico como plan a seguir, tomando en cuenta la revisión documental y la entrevista de expertos para precisar que la prueba para mejor resolver se constituye en el COGEP y en la Constitución de 2008 como herramienta excepcional, motivada y eficiente para disminuir las posibilidades de error de la decisión judicial, al aumentar el grado de probabilidad de que la decisión se corresponda con lo que efectivamente sucedió.

Being the general objective of this research to analyze the legal effectiveness of the official evidence contained in the COGEP and its legality in relation to the principle of impartiality in family processes, alimony in 2020, in the canton Ibarra, it is appealed to the qualitative approach, with a descriptive depth level due to the fact that the state of the investigation and the effectiveness of the judicial evidence are detailed, which leads to the application of the deductive method and the hermeneutical method as a plan to follow, taking into account The documentary review and the expert interview account to specify that the evidence to better resolve is constituted in the COGEP and in the 2008 Constitution as an exceptional, motivated and efficient tool to reduce the possibilities of error in the judicial decision, by increasing the degree probability that the decision corresponds to what actually happened.
