La ausencia de una ordenanza municipal que garantice los derechos de seguridad, integridad física y libre tránsito de los ciclistas en los espacios públicos del cantón Antonio Ante, provincia de Imbabura

Abstract

Esta investigación partió del problema ¿Por qué no se ha garantizado los derechos de seguridad, integridad física y libre tránsito de los ciclistas del cantón Antonio Ante, provincia de Imbabura? Tuvo como objetivo general Determinar si los derechos de los ciclistas han sido reconocidos por el Gobierno Autónomo Descentralizado del Cantón Antonio Ante. La investigación parte de un enfoque cualitativo, niveles de investigación exploratorio y como método utilizado, es el socio-jurídico mismo que ha permitido aplicar el Derecho a partir del estudio de un problema social; como técnicas de investigación la entrevista, y revisión documental y como instrumentos el cuestionario, que ha permitido comprender con mayor profundidad el problema de la afectación de los Derechos Constitucionales. Teóricamente se sustentó en normativas sobre los derechos de seguridad, integridad física y libre tránsito, dentro del desarrollo de la revisión normativa y documental se hace mayor énfasis sobre los derechos de los ciclistas: los resultados reflejan la urgencia de una ordenanza que garantice los derechos de seguridad, integridad física y libre tránsito de los ciclistas en los espacios públicos del Cantón Antonio Ante. This investigation started from the problem. Why have the safety, physical integrity and free transit rights of cyclists from the Antonio Ante canton, Imbabura province not been guaranteed? Its general objective was to determine whether the Decentralized Autonomous Government of the Canton Antonio Ante has recognized the rights of cyclists. The research starts from a qualitative approach, exploratory research levels and as a method used, it is the socio-legal itself that has allowed applying the Law from the study of a social problem; as research techniques the interview, and documentary review and as instruments the questionnaire, which has allowed us to understand more deeply the problem of the affectation of Constitutional Rights. Theoretically, it was based on regulations on the rights of security, physical integrity and free transit; within the development of the regulatory and documentary review, greater emphasis is placed on the rights of cyclists: the results reflect the urgency of an ordinance that guarantees the rights of safety, physical integrity and free movement of cyclists in the public spaces of Cantón Antonio Ante.
