Abstract
La importancia de las garantías constitucionales normativas y el trato digno hacia los menores infractores es de vital importancia partiendo de la idea que los adolescentes por estar aún en proceso de desarrollo físico, psicológico y emocional bajo ningún concepto pueden considerarse que ellos infrinjan las Leyes Penales, sino que sus acciones son los resultados dentro de la sociedad en que viven familias desintegradas, violencia intrafamiliar, ya que el núcleo familiar es muy importante en la educación de nuestro niños, niñas y adolescentes fortaleciéndoles con valores y principios. Además, los estados a través de instrumentos internacionales, leyes, normas y políticas públicas garantizan y tutelan los derechos, en donde los encargados de aplicar una justicia restaurativa juvenil son los jueces a través de medidas socioeducativas con la ayuda de psicólogos, trabajadoras sociales, la familia y la sociedad lograremos que los menores tengan una vida digna llena de oportunidades en un futuro reinsertándose en la sociedad como entes positivos.
The importance of normative constitutional guarantees and the dignified treatment of juvenile offenders is of vital importance based on the idea that adolescents, because they are still in the process of physical, psychological and emotional development, can not be considered as infringing the Criminal Laws, but that their actions are the results within the society in which disintegrated families live, intrafamily violence, since the family nucleus is very important in the education of our children and adolescents, strengthening them with values and principles. In addition, states through international instruments, laws, norms and public policies guarantee and protect rights, where those responsible for applying juvenile restorative justice are judges through socio-educational measures with the help of psychologists, social workers, the family and society will ensure that children have a dignified life full of opportunities in the future by reinserting themselves in society as positive entities.
