Abstract
La contratación electrónica requiere inexorablemente garantías en relación con ciertos
aspectos básicos de la seguridad jurídica, como la identificación de las partes, la
privacidad de las comunicaciones, la seguridad e integridad de los mensajes y el no
repudio del contrato por cualquiera de las partes. En un proceso de contratación en el que
las partes no tienen por qué conocerse, ni llegar a verse físicamente, esas garantías deben
proceder de la implementación de nuevos mecanismos electrónicos y de su regulación
legal. En ello precisamente consiste la firma electrónica. Siendo el objetivo general de esta
investigación conocer la correcta aplicación y el procedimiento adecuado de las firmas
electrónicas en los contratos privados, se direcciona en un enfoque cualitativo, con un
nivel de profundidad descriptivo debido a que se procede a detallar el estado de la
investigación y la problemática actual de las firmas electrónicas dentro del contexto de la
contratación privada, lo que lleva a la aplicación del método deductivo y el método
normativista como plan a seguir, tomando en cuenta la revisión documental y la entrevista
a los fines de determinar que el uso y la aplicación de la firma electrónica constituye un
gran avance tecnológico respaldado en la legislación ecuatoriana, pero falta cultura y
conocimiento sobre la misma, así como generar confiabilidad en esta herramienta
electrónica que trae grandes ventajas en la contratación electrónica privada.
Electronic contracting inexorably requires guarantees in relation to certain basic aspects of legal certainty, such as the identification of the parties, the privacy of communications, the security and integrity of the messages and the non-repudiation of the contract by any of the parties. In a contracting process in which the parties do not have to know each other, nor do they have to see each other physically, these guarantees must come from the implementation of new electronic mechanisms and their legal regulation. This is precisely what the electronic signature consists of. Being the general objective of this research to know the correct application and the appropriate procedure of electronic signatures in private contracts, it is addressed in a qualitative approach, with a level of descriptive depth because it proceeds to detail the status of the investigation and the current problems of electronic signatures within the context of private contracting, which leads to the application of the deductive method and the normative method as a plan to follow, taking into account The documentary review and the interview account for the purpose of determining that the use and application of the electronic signature constitutes a great technological advance supported by Ecuadorian legislation, but there is a lack of culture and knowledge about it, as well as generating reliability in this electronic tool which brings great advantages in private electronic contracting.
