Abstract
Esta investigación fue sobre la eficacia de la Ordenanza municipal que regula el faenamiento animal y su relación con el derecho a la salud de los consumidores de la ciudad de Mira, cuyo período de estudio fue 2016-2018. El faenamiento de animales es un proceso técnico ordenado sanitariamente para el sacrificio de animales, con el objeto de obtener su carne o producto en condiciones óptimas para el consumo humano; sometido, según la ley, a un estricto seguimiento al momento de realizarlo, teniendo en cuenta la estructura, infraestructura y personal profesional capacitado para un control pre y post mortem de los animales, para posteriormente obtener un producto de calidad y apto para el consumo humano. El objetivo de la investigación fue determinar la eficacia de la Ordenanza municipal reguladora del funcionamiento del centro de faenamiento de la ciudad de Mira en el periodo 2016-2018. Dicha ordenanza establece, conjuntamente con otras leyes conexas, los lineamientos de salubridad, el personal que debe realizarlo, el bienestar animal y el control de calidad que debe tener la carne que se oferta en este centro de faenamiento. El método utilizado fue el socio jurídico, con el apoyo del método deductivo. Esta investigación es importante porque permitió determinar la eficacia de la normativa jurídica reguladora del faenamiento animal y su repercusión en la alimentación humana. Entre los resultados de la investigación están los problemas de salud detectados, como consecuencia del consumo de carne proveniente de dicho centro. En conclusión, se determinó que la Ordenanza municipal nro. 001-2016 no ha sido eficaz, por cuanto que sus normas básicas no han sido cumplidas en el proceso del centro de faenamiento en el período 2016-2018.
This research was on the effectiveness of the municipal ordinance that regulates animal slaughter and its relationship with the right to health of consumers in the city of Mira, whose study period was 2016-2018. The slaughter of animals is a technical process ordered healthily for the slaughter of animals, in order to obtain their meat or product in optimal conditions for human consumption; subjected, according to the law, to a strict monitoring at the time of carrying it out, taking into account the structure, infrastructure and professional personnel trained for a pre and post mortem control of the animals, to later obtain a quality product suitable for human consumption . The objective of the research was to determine the effectiveness of the municipal ordinance regulating the operation of the slaughterhouse in the city of Mira in the period 2016-2018. Said ordinance establishes, together with other related laws, the health guidelines, the personnel who must perform it, the animal welfare and the quality control that the meat that is offered in this slaughterhouse must have. The method used was the legal partner, with the support of the deductive method. This research is important because it made it possible to determine the effectiveness of the legal regulations governing animal slaughter and its impact on human nutrition. Among the results of the investigation are the health problems detected, as a consequence of the consumption of meat from said center. In conclusion, it was determined that Municipal Ordinance no. 001-2016 has not been effective, since its basic standards have not been met in the slaughterhouse process in the 2016-2018 period.
