Abstract
El informe del trabajo final de titulación, Análisis jurídico sobre la pérdida de la patria potestad
respecto de los niños, niñas y adolescentes en el cantón de Ibarra durante el período 2019-2021,
plantea una postura socio-jurídica, partiendo de los análisis descriptivos de los expedientes
10203-2021-00367, 10203-2019-01495, 10203-2019-00924 acerca de la privación de la patria
potestad, para así poder brindar un enfoque de realidad a la investigación, poder analizar
adecuadamente la normativa; y por ende, verificar mediante este tipo de procesos que el cuidado
adecuado de los niños, niñas y adolescentes se encuentre debidamente garantizado.
A partir de ello, el análisis y discusión de los resultados tanto de la parte teórica como práctica,
nos indica que el accionar judicial se encuentra basado de manera determinante en la
observancia y cumplimiento de la legislación aplicable en estos casos que es el Código Orgánico
de la Niñez y Adolescencia; de manera procesal los jueces de la Unidad Judicial de Familia,
Mujer, Niñez, Adolescencia y Adolescentes Infractores, basan sus decisiones sobre la privación
o no de la patria potestad en relación al mérito probatorio, esto es, las pruebas que presentan los
sujetos procesales e incluso aquellas dispuestas de oficio para alcanzar un conocimiento pleno,
para que de esta manera, se logre materializar el principio del interés superior del niño, mismo
que es indispensable y por medio del cual se busca que los menores de edad puedan vivir en un
ambiente adecuado, sano y de armonía para su desarrollo, con el ejercicio pleno de sus derechos,
respaldados con la Constitución de la República y los Tratados Internacionales aplicables al
efecto como la Convención sobre los Derechos del Niño.
The report of the final degree work, 'Legal analysis on the loss of parental authority regarding children and adolescents in the canton of Ibarra during the period 2019-2021', proposes a socio legal position, based on the analyzes descriptions of the files 10203-2021-00367, 10203-2019- 01495, 10203-2019-00924 about the deprivation of parental authority, in order to provide a reality-based approach to the investigation, to be able to properly analyze the regulations\; and therefore, verify through this type of process that the adequate care of children and adolescents is duly guaranteed. From this, the analysis and discussion of the results of both the theoretical and practical part, indicates that the judicial action is based in a decisive way on the observance and compliance with the applicable legislation in these cases, which is the Organic Code of Childhood and Adolescence\; procedurally, the judges of the Judicial Unit for Family, Women, Children, Adolescents and Adolescents Offenders, base their decisions on the deprivation or not of parental authority in relation to the probative merit, that is, the evidence presented by the procedural subjects and even those willing ex officio to achieve full knowledge, so that in this way, the principle of the best interests of the child can be materialized, which is essential and through which it is sought that minors can live in an adequate environment , healthy and harmonious for their development, with the full exercise of their rights, backed by the Constitution of the Republic and applicable international treaties such as the Convention on the Rights of the Child.
