Abstract
En este trabajo de investigación se tituló Evolución y características del derecho a un ambiente sano en la Constitución del Ecuador de 2008, misma que ratificó el derecho a disfrutar de un ambiente y, al mismo tiempo, reconoció a la naturaleza como sujeto de aquellos derechos previstos en dicha Carta Fundamental, la cual ha promovido la creación de leyes y políticas públicas orientadas a evitar o mitigar los impactos ambientales negativos. El desarrollo constitucional del goce efectivo del derecho al ambiente se evidenció desde la Constitución Política de 1979 y, sin duda alguna, se ha fortalecido con la actual Norma Fundamental, misma que estableció los mecanismos de protección tanto al ambiente como a la naturaleza, velando por el bienestar y supervivencia de las generaciones futuras, así como la responsabilidad estatal de controlar y regular las actividades de las empresas, facultando a todas las personas a exigir a la autoridad competente el cumplimiento de los postulados normativos ambientales o, en su defecto, solicitar la reparación integral y remediación de daños. En este contexto, el objetivo general de esta investigación fue determinar la naturaleza del derecho al ambiente sano y ecológicamente equilibrado en el ordenamiento jurídico nacional. El enfoque de la investigación fue cualitativo y el nivel de profundidad fue descriptivo. Los métodos aplicados fueron el normativista y el comparado, con apoyo del método deductivo. La importancia de este trabajo radica en su valoración del derecho individual y colectivo a un ambiente sano y ecológicamente equilibrado, el cual es una institución emblemática del Derecho Ambiental nacional e internacional. Finalmente, se concluyó que el derecho a un ambiente sano es un derecho subjetivo, que pude disfrutarse tanto individual, como colectivamente.
This research work was entitled Evolution and characteristics of the right to a healthy environment in the Ecuadorian Constitution of 2008, which ratified the right to enjoy an environment and, at the same time, recognized nature as a subject of those rights. provided for in said Fundamental Charter, which has promoted the creation of laws and public policies aimed at avoiding or mitigating negative environmental impacts. The constitutional development of the effective enjoyment of the right to the environment has been evident since the Political Constitution of 1979 and, without a doubt, has been strengthened with the current Fundamental Norm, which established the protection mechanisms for both the environment and nature, ensuring the well-being and survival of future generations, as well as the state responsibility to control and regulate the activities of companies, empowering all people to demand that the competent authority comply with the environmental regulatory postulates or, failing that, request the Comprehensive repair and remediation of damages. In this context, the general objective of this research was to determine the nature of the right to a healthy and ecologically balanced environment in the national legal system. The research approach was qualitative and the level of depth was descriptive. The methods applied were normative and comparative, with the support of the deductive method. The importance of this work lies in its assessment of the individual and collective right to a healthy and ecologically balanced environment, which is an emblematic institution of national and international Environmental Law. Finally, it was concluded that the right to a healthy environment is a subjective right, which can be enjoyed both individually and collectively.
