Abstract
El presente trabajo de investigación se tituló “Corresponsabilidad de los padres separados y los derechos de sus hijos menores en el cantón Otavalo”, se fundamentó teóricamente en el análisis de investigaciones previas\; del marco jurídico constitucional y legal, derecho internacional y sentencia de la Corte Constitucional. Tuvo como objetivo general determinar la aplicación de la corresponsabilidad de los padres separados y los derechos de sus hijos menores mediante el estudio de las sentencias emitidas por los jueces de primer nivel, para conocer si se garantizan los derechos de los hijos menores y de sus progenitores. Su importancia radica en la generación de conocimiento y análisis de un problema social que afecta a hijos menores y sus familias. Los métodos utilizados en la investigación fueron el socio jurídico, analítico, inductivo-deductivo. Los resultados señalan que en las decisiones judiciales que resuelven la tenencia de hijos menores persiste la tendencia de concederla a la madre\; no existen mecanismos que garanticen al progenitor que no tiene la custodia, ejercer su derecho/deber de corresponsabilidad parental. Las decisiones judiciales no muestran resultados visibles para hacer efectivos los derechos de igualdad y no discriminación del padre y la madre para asumir la tenencia de sus hijos menores en los casos de separación. Al asignar la tenencia a la madre en los procesos en los que el padre no concurre, no se demuestra que efectivamente se esté garantizando el derecho/deber de corresponsabilidad parental, de igualdad ante y no discriminación del padre y el interés superior del niño o adolescente.
This research work was entitled 'Co-responsibility of separated parents and the rights of their minor children in the canton of Otavalo' and was theoretically based on the analysis of previous research, the constitutional and legal framework, international law, and Constitutional Court rulings. Its general objective was to determine the application of the co-responsibility of separated parents and the rights of their minor children through the study of the sentences issued by the first level judges, to know if the rights of minor children and their parents are guaranteed. Its importance lies in the generation of knowledge and analysis of a social problem that affects minor children and their families. The methods used in the research were socio-legal, analytical, inductive-deductive. The results indicate that in the judicial decisions that resolve the custody of minor children, the tendency persists to grant custody to the mother\; there are no mechanisms that guarantee that the non-custodial parent can exercise his/her right/duty of parental co-responsibility. Judicial decisions do not show visible results to make effective the rights of equality and non-discrimination of the father and the mother to assume custody of their minor children in cases of separation. By assigning custody to the mother in proceedings in which the father does not attend, there is no evidence that the right/duty of parental co-responsibility, equality before and non-discrimination of the father and the best interests of the child or adolescent are being effectively guaranteed.
