Abstract
El estado de excepción ha sido un tema social de gran controversia dentro del Estado
ecuatoriano, tanto en el año 2019 como en el año 2020, puesto que se presentaron distintos
acontecimientos que afectaron de manera directa a la población ecuatoriana y al propio
Estado. A partir de este contexto, surgió el interés por realizar este trabajo de investigación el
cual pretende el análisis del impacto de la limitación del ejercicio de derechos a causa de la
declaración del estado de excepción en el Ecuador, durante los años 2019 – 2020; mismo que
centra su interés en las limitaciones del ejercicio de derechos que surgió en el ámbito del
referido estado de excepción y que, sin duda alguna, se expresó en el tratamiento de las
manifestaciones de octubre del 2019 en contra de las medidas económicas, que derivó la
aplicación del Decreto Ejecutivo 884, al igual que el estado de excepción aplicado en marzo
del 2020 a través del Decreto Ejecutivo 1017, por la crisis sanitaria del COVID 19, lo que
ocasionó limitaciones de determinados derechos y se restringieron varias actividades, que
impactaron a la población ecuatoriana. En este sentido, el objetivo general de esta
investigación fue analizar aquellos derechos que se limitaron con la declaración del estado de
excepción y su impacto en la población ecuatoriana. El método utilizado fue el socio jurídico,
con el apoyo del método deductivo. En todo caso, el estado de excepción limitó el ejercicio
de derechos, lo cual repercutió en la población ecuatoriana, cuyo impacto se sintió de manera
directa e indirecta en la educación, la economía, la libertad, la movilidad y en otros ámbitos.
Basándose en una investigación documental y a través de entrevistas. Aportando así con una
investigación de calidad, la cual aportará a la sociedad en general.
The state of emergency has been a social issue of great controversy within the Ecuadorian State, both in 2019 and 2020, since there were different events that directly affected the Ecuadorian population and the State itself. From this context, the interest arose to carry out this work, entitled 'Analysis of the impact of the limitation of the exercise of rights due to the declaration of the state of exception in Ecuador, during the years 2019 - 2020', which focused its interest in the limitations of the exercise of rights that arose in the scope of the referred state of exception and that, without any doubt, was expressed in the treatment of the demonstrations of October 2019 against the economic measures, which derived the application of Executive Decree 884, as well as the state of exception applied in March 2020 through Executive Decree 1017, due to the health crisis of COVID 19, which caused limitations of certain rights and several activities were restricted, which impacted the Ecuadorian population. In this sense, the general objective of this research was to analyze those rights that were limited with the declaration of the state of emergency and its impact on the Ecuadorian population. The method used was the socio-legal one, with the support of the deductive method. In any case, the state of emergency limited the exercise of rights, which had repercussions on the Ecuadorian population, whose impacts were felt directly and indirectly in education, economy, freedom, mobility and other areas that, in one way or another, were also affected.
