Abstract
En Ecuador existen 11 Centros de Internamiento para Adolescentes Infractores que asisten al proceso de rehabilitación y reinserción de los menores que fueron hallados culpables del cometimiento de un ilícito a través de mecanismos de formación y tratamiento psicológico y afectivo. Sin embargo, se han detectado varias dificultades en lo referenteal proceso de aplicación de las normas y estándares mínimos tendentes a garantizar un nivel de reinserción social óptima, lo que ha generado una posible violación directa de los derechos de los/las menores infractores/as, así como el incumplimiento de las obligaciones estatales respecto a políticas públicas y protección de los derechos fundamentales de estas personas. Por ello, el presente trabajo de investigación responde a la siguiente pregunta de investigación: ¿Las medidassocioeducativas aplicadas en el Centro de Adolescentes Infractores de la Ciudad de Ibarrason eficientes para lograr la reinserción social del adolescente infractor? En este contexto, el objetivo general fue analizar el rendimiento de las medidas socio educativas impuestas a los adolescentes infractores por medio de la observación de los mecanismos jurídicos institucionales usados y la estadística de reinserción para cuantificar la eficacia y eficiencia de las medidas impuestas a los adolescentes infractoresen el año 2018 en el Centro de Adolescentes Infractores de la ciudad de Ibarra. El enfoque de este trabajo fue cualitativo; su nivel, explicativo; sus métodos, normativista y socio jurídica; sus técnicas consistieron en la revisión documental y en las entrevistas; y, los instrumentos empleados fueron las fichas bibliográficas y resumen y el cuestionario de preguntas para los entrevistados.
In Ecuador there are 11 Internment Centers for Adolescent Offenders that assist in the rehabilitation and reintegration process of minors who were found guilty of committing an offense through training mechanisms and psychological and affective treatment. However, several difficulties have been detected in relation to the process of applying the minimum norms and standards aimed at guaranteeing an optimal level of social reintegration, which has generated a possible direct violation of the rights of minor offenders, as well as the breach of state obligations regarding public policies and protection of the fundamental rights of these people. For this reason, this research work answers the following research question: Are the socio-educational measures applied in the Center for Adolescent Offenders of the City of Ibarra efficient in achieving the social reintegration of the adolescent offender? In this context, the general objective was to analyze the performance of the socio-educational measures imposed on adolescent offenders through the observation of the institutional legal mechanisms used and the reintegration statistics to quantify the effectiveness and efficiency of the measures imposed on adolescents. offenders in 2018 at the Center for Adolescent Offenders in the city of Ibarra. The focus of this work was qualitative; its level, explanatory; its methods, normative and socio-legal; his techniques consisted of documentary review and interviews; and, the instruments used were the bibliographic records and summary and the questionnaire of questions for the interviewees.
