Estudio de la mediación como forma de resolución de conflictos en el ámbito de familia, mujer, niñez y adolescencia en la cuidad de Ibarra provincia de Imbabura periodo 2019-2020

Abstract

La medición dentro de la legislación ecuatoriana se ha considerado de suma importancia para la resolución de litigios legales de manera extrajudicial, por tal motivo se toma como objetivo general el Estudio del sistema de mediación en el ámbito de familia mujer niñez y adolescencia en la cuidad de Ibarra para determinar cómo problema principal el estado en el que se encuentra el sistema de mediación en la cuidad de Ibarra en el periodo 2019-2020, y así analizar el alcance, procedimiento y características de la mediación familiar, por ello se utilizó un enfoque cualitativo el cual ayuda a identificar la eficacia, validez y la rapidez del procedimiento, conjuntamente se utiliza el método deductivo, analítico y socio jurídico, para tener datos claros y precisos sobre el tema a sustentar, por consiguiente se obtiene información precisa en base a las entrevista y análisis documental como técnica. Entre las conclusiones más relevantes es el procedimiento que se sigue dentro de la causa de mediación familiar el acceso rápido y asequible que tiene la mediación y como se ha incrementado la concurrencia de casos en la cuidad de Ibarra desde el año 2019 al 2020, lo que hace que la mediación en temas de familia tenga un porcentaje más alto a consideración con otras materias que también utilizan en la mediación. The measurement within the Ecuadorian legislation has been considered of great importance for the resolution of legal disputes in an out-of-court manner, for this reason the study of the mediation system in the field of family, women, children and adolescents in the city of Ibarra to determine how the main problem is the state of the mediation system in the city of Ibarra in the period 20192020, and thus be able to analyze the scope, its procedure and characteristics of family mediation, for this reason a qualitative approach which helps us to identify the effectiveness, validity and speed of the procedure, jointly the deductive, analytical and socio-legal method is used to have clear and precise data on the subject to support, to obtain precise information the interview is carried out and documentary analysis as a technique. Among the most relevant conclusions is the procedure that is followed within the family mediation process, the fast and affordable access that mediation has and how the number of cases in the city of Ibarra has increased from 2019 to 2020, which makes that mediation in family issues has a higher percentage to consider with other matters that are also used in mediation.
