Abstract
El presente trabajo de investigación aborda el tema de la falta de comparecencia de una de las partes a las audiencias sobre el derecho a alimentos con presunción de paternidad, según el Código Orgánico General de Procesos, en el Ecuador, tomando en cuenta el vacío legal existente en la normativa ecuatoriana, siendo que no existen los lineamientos para que el juez pueda tomar una decisión cuando se le presente este escenario. Frente a este supuesto de hecho se ha visto como problemática que las decisiones tomadas por los jueces puedan afectar por un lado los derechos de los niños, niñas y adolescentes que en este caso son para los que se reclama el derecho de alimentos y por otro lado están los derechos del demandado pudiendo establecerse la vulneración en sus derechos económicos. La norma que se toma en cuenta para este caso es el artículo 87 del Código Orgánico General de Procesos en el que determina que la falta de asistencia a las audiencias se puede considerar como abandono contraviniendo con el artículo 247 del mismo cuerpo legal que se establece que es improcedente el abandono cuando en el proceso estén inmersos niños, niñas y adolescentes, la Corte Nacional de Justicia ha tratado de suplir este vacío legal estableciendo que cuando la parte actora no comparezca a la audiencia se ratificará la pensión provisional, pero esta resolución no ha tomado en cuenta qué pasaría en los juicios de presunción de paternidad dejando así un gran vacío en el sistema procesal ecuatoriano, mismo que hasta el momento no ha sido tratado ni suplido. En el sistema jurídico es importante tener las normas preestablecidas para así poder tener certeza jurídica sobre el escenario a cuál nos enfrentamos, es por esto que se realizó esta investigación para poder dar solución a esta problemática dentro de la actividad jurisdiccional. Para la presente investigación se ha plasmado el nivel descriptivo y el método lógico analítico para poder obtener las conclusiones pertinentes, siendo una de estas que a pesar de que el juzgador no cuenta una norma expresa, ha optado para garantizar el derecho de las partes, señalar nueva fecha para la realización de la audiencia pudiendo hacerlo las veces necesarias hasta que la parte actora comparezca.
The present research work addresses the issue of the non-appearance of one of the parties to the hearings on the right to maintenance with presumption of paternity, according to the General Organic Code of Processes, in Ecuador, taking into account the legal vacuum existing in the Ecuadorian legislation, since there are no guidelines for the judge to make a decision in this scenario. Faced with this factual assumption, it has been seen as problematic that the decisions made by the judges may affect on the one hand the rights of children and adolescents who in this case are those for whom the right to food is claimed and on the other hand are the rights of the defendant and may establish the violation of their economic rights. The norm that is taken into account in this case is article 87 of the General Organic Code of Proceedings which determines that the lack of attendance to the hearings can be considered as abandonment in contravention of article 247 of the same legal body which establishes that abandonment is inadmissible when children and adolescents are involved in the process, The National Court of Justice has tried to fill this legal void by establishing that when the plaintiff does not appear at the hearing the provisional pension will be ratified, but this resolution has not taken into account what would happen in the trials of paternity presumption, thus leaving a great void in the Ecuadorian procedural system, which so far has not been addressed or filled. In the legal system it is important to have pre-established rules in order to have legal certainty about the scenario we face, which is why this research was conducted to provide a solution to this problem within the jurisdictional activity. For the present investigation the descriptive level and the analytical logical method have been used to obtain the pertinent conclusions, obtaining as conclusions that in spite of the fact that the judge does not have an express norm, he has chosen to guarantee the right of the parties, to indicate a new date for the realization of the hearing being able to do it as many times as necessary until the plaintiff appears.
