Abstract
Desde la Constitución de 2008, el uso de drogas se considera un problema de salud
pública, por lo que, se reformó el ordenamiento jurídico en la posibilidad de especificar
dosis mínimas y de imponer tratamientos en lugar de criminalizarlo; por ello, el Código
Orgánico Integral Penal lo tipifica y remite a una norma administrativa para definir las
cantidades máximas admisibles para consumo personal. En aras de profundizar en este
tema, de relieve jurídico, en Ecuador, el objetivo general trazado fue determinar la
aplicación del artículo 220 del Código Orgánico Integral Penal en los casos de tenencia
o posesión de drogas para uso o consumo personal en el Cantón Ibarra en el periodo
2017-2020, para determinar la vulneración de los derechos de estas personas,
direccionado en un enfoque cualitativo, con un nivel de profundidad descriptivo, debido
a que se procedió a detallar el estado de la investigación y la problemática actual de la
no penalización de la tenencia o posesión de drogas para uso o consumo personal; lo
que llevó a la aplicación del método hermenéutico como actividad interpretativa y el
método deductivo como plan a seguir, y se tomó en cuenta la revisión documental a los
fines de determinar la racionalización de la administración de penas relacionadas con las
drogas en Ecuador. La reforma del Código Orgánico Integral Penal y la reciente
sentencia de la Corte Constitucional han mejorado la aplicación de este artículo legal,
debido a que la aplicación práctica de los umbrales como un mecanismo de
descriminalización del consumo, trae como consecuencia el respeto y garantía de los
derechos humanos, como el derecho a la salud, a la libertad, a una vida digna, como
efectos inmediatos derivados de la implementación de estas reformas.
