Abstract
“La Reserva Ecológica “El Ángel” y el Respeto de los Derechos de la Naturaleza, periodo 2018-2019”, centró su atención en la naturaleza como sujeto de derecho\; la cual está representada por el paisaje de los páramos, flora y fauna de especies endémicas que habitan en la Reserva, cuyos derechos forma parte del catálogo previsto en la Constitución y las leyes\; no obstante, dicha Reserva Ecológica ha recibido algunos impactos ambientales que, de alguna manera, han podido haberla afectando negativamente. El objetivo de la investigación fue determinar el cumplimiento efectivo de los derechos de la naturaleza en la Reserva Ecológica, cuya protección no es solamente por sus bellezas escénicas naturales, sino también por sus recursos hídricos provenientes de sus páramos y humedales, lo cual la destaca como una importante fuente de abastecimiento para varias cuencas hidrográficas\; de allí, la importancia del presente trabajo. Esta área protegida ha sido frecuentemente amenazada por incendios forestales, el avance de frontera agrícola, el uso de agroquímicos, caza de especies en peligro de extinción y, de igual manera, por falta de coordinación entre las instituciones competentes para tomar medidas contra los agentes que han violado los derechos de la naturaleza. De allí que pueda evidenciarse, sin duda alguna, un déficit en el respeto de los derechos de la naturaleza establecidos en la Constitución y demás leyes de la República.
The Ecological Reserve' El Ángel 'and Respect for the Rights of Nature, period 2018- 2019', focused its attention on nature as a subject of law\; which is represented by the landscape of the moors, flora and fauna of endemic species that inhabit the Reserve, whose rights are part of the catalog provided in the Constitution and laws\; however, said Ecological Reserve has received some environmental impacts that, in some way, may have affected it negatively. The objective of the research was to determine the effective fulfillment of the rights of nature in the Ecological Reserve, whose protection is not only for its natural scenic beauties, but also for its water resources from its moors and wetlands, which highlights it as an important source of supply for several hydrographic basins\; hence, the importance of this work. This protected area has been frequently threatened by forest fires, the advance of the agricultural frontier, the use of agrochemicals, hunting of species in danger of extinction and, in the same way, for lack of coordination between the competent institutions to take measures against the agents that have violated the rights of nature. Hence, a deficit in the respect of the rights of nature established in the Constitution and other laws of the Republic can be evidenced.
