Abstract
Los medios de comunicación resultan ser una herramienta fundamental en el proceso comunicativo, sin embargo en el ejercicio de sus actividades emiten información acerca de procesos judiciales que se están llevando a cabo, un mal manejo de esta información podría implicar serias vulneraciones a derechos y al debido proceso, por lo tanto es importante analizar cómo la presión mediática se manifestó en el caso David Piña considerado un caso mediático dado que en torno a la cobertura y al manejo informativo que tuvieron los medios de comunicación como Teleamazonas, El Universo, El Telégrafo, El Extra fue un detonante en el dictamen de una sentencia en contra de David Piña a 25 años de prisión por el asesinato de Karina del Pozo. Este trabajo se abordó desde un enfoque cualitativo el cual permitió realizar un análisis detallado respecto al rol que tienen los medios de comunicación y cómo influyeron en la imparcialidad del proceso. Los métodos aplicados fueron el método socio jurídico normativista, deductivo. El método socio jurídico permitió estudiar el rol que cumplen los medios de comunicación dentro de la sociedad, con el método deductivo se pretende realizar un estudio sobre los derechos y principios que están siendo vulnerados dentro del caso, el método normativista permitió realizar un estudio del concepto de las normas de esta manera permitirá establecer conclusiones sobre la situación actual, e identificar si los medios de comunicación actuaron de una manera ilegitima o legitima dentro de los casos de estudio. A razón de ello como resultado se obtuvo que evidentemente esté fue un caso mediático y que mediante sentencia de la Corte Constitucional de Justicia se determinó que efectivamente se violentaron derechos constitucionales.
The media turn out to be a fundamental tool in the communicative process, however in the exercise of their activities they issue information about judicial processes that are being carried out, mishandling this information could imply serious violations of rights and due process, therefore it is important to analyze how the media pressure manifested itself in the David Piña case, considered a media case given that the coverage and information handling of the media such as Teleamazonas, El Universo, El Telégrafo, El Extra was a trigger in the ruling of a sentence against David Piña to 25 years in prison for the murder of Karina del Pozo. This work was approached from a qualitative approach which allowed a detailed analysis regarding the role of the media and how they influenced the impartiality of the process. The methods applied were the normativist, deductive socio-legal method. The socio-legal method allowed to study the role played by the media within society, with the deductive method it is intended to carry out a study on the rights and principles that are being violated within the case, the normative method allowed to carry out a study of the concept of the norms in this way will allow to establish conclusions about the current situation, and identify if the media acted in an illegitimate or legitimate way within the case studies. As a result, as a result, it was evident that this was a media case and that by ruling of the Constitutional Court of Justice it was determined that constitutional rights were indeed violated.
