Análisis jurídico sobre desinformación sobre la donación y trasplante de órganos en la ciudad de Ibarra, provincia de Imbabura - Ecuador (abril 2021- agosto 2022)

Abstract
La donación de órganos en Ecuador se inicia en 1976 y hasta el 2011 ya se habían realizado 2450 trasplantes; a la fecha el 94% de ecuatorianos tienen la condición de donantes, en este sentido la investigación se enmarca en un análisis jurídico sobre el problema de la desinformación sobre la donación y trasplante de órganos en la ciudad de Ibarra, (abril 2021- agosto 2022), la donación de órganos es un beneficio social, solidario y altruista, que se encuentra en la Ley (2011), sin embargo, sobre la normativa para ser donante o beneficiario hay desconocimiento y desinformación. En tal virtud, se ha formulado como objetivos determinar los criterios jurídicos de los profesionales en derecho; identificar si los ciudadanos, están informados y conocen sobre la donación; para ello se ha planteado las siguientes preguntas ¿La falta de información en la ciudadanía sobre la donación de órganos, tejidos y células, es consecuencia de la poca aceptación a ser donantes?; ¿El desconocimiento sobre la donación de órganos y tejidos, es un problema social y cultural; que se concreta en la necesidad de socialización e información?. Para ejecutar este estudio, alcanzar los objetivos y dar respuesta, se empleó la metodología cualitativa y cuantitativa, para ello, se realizó el análisis bibliográfico, documental, entrevistas y encuestas a profesionales del derecho que aportaron con datos específicos y de los ciudadanos que manifestaron estar o no informados sobre el tema. De esta manera, se ha evidenciado que hay desconocimiento de la población sobre leyes y normativas para ser donantes y beneficiarios. Además, se ha establecido que, si existe mayor promoción y difusión de las instituciones públicas y privadas, se podrá ampliar y mejorar su cobertura de información y conocimientos.
Organ donation in Ecuador began in 1976 and by 2011, 2,450 transplants had already been performed; To date, 94% of Ecuadorians have donor status, in this sense the research is part of a legal analysis on the problem of misinformation about organ donation and transplantation in the city of Ibarra, (April 2021- August 2022), organ donation is a social, supportive and altruistic benefit, which is found in the Law (2011), however, there is ignorance and misinformation about the regulations to be a donor or beneficiary. In such virtue, it has been formulated as objectives to determine the legal criteria of the professionals in law; identify if citizens are informed and know about the donation; To this end, the following questions have been raised: Is the lack of information among citizens about the donation of organs, tissues and cells, a consequence of the low acceptance of being donors? Ignorance about organ and tissue donation is a social and cultural problem; What is specified in the need for socialization and information. To execute this study, achieve the objectives and respond, the qualitative and quantitative methodology was used, for this, the bibliographical and documentary analysis, interviews and surveys were carried out with legal professionals who contributed with specific data and with the citizens who stated that they were or uninformed on the subject. In this way, it has been shown that there is a lack of knowledge of the population about laws and regulations to be donors and beneficiaries. In addition, it has been established that, if there is greater promotion and dissemination of public and private institutions, it will be possible to expand and improve their coverage of information and knowledge.
