Abstract
El presente trabajo de investigación determina la validez y credibilidad de los exámenes psicosomáticos, como un elemento atenuante o agravante para los jueces de tránsito en la ciudad de Ibarra, hacia las contravenciones de tránsito por conducir bajo la influencia del alcohol, mediante una investigación cualitativa a una recopilación documental histórica en repositorios, encuestas, sentencias y apelaciones de tránsito y artículos, utilizando el trabajo hermenéutico y sistemático, reiterando su importancia en el principio pro homine en prevalecer la interpretación de las normas en favor de la inocencia del mismo, obteniendo como resultados la decisión del libre albedrio de los jueces de tránsito argumentando vacíos jurídicos existentes en la normativa legal vigente, el principio de subjetividad debido a la autovaloración crítica del agente de tránsito y conductores hacia las pruebas psicosomáticas, todo estos elementos dirigidos hacia al Art 182 de la Ley Orgánica De Transporte Terrestre Tránsito y Seguridad Vial y su respectivo Reglamento, hacia la vulneración de derechos contra la seguridad jurídica y presunción de inocencia de los conductores. Así entonces, los exámenes psicosomáticos deben ser un mecanismo que cumple con la finalidad de contribuir como elemento de convicción y credibilidad, para la correcta aplicación del debido proceso al conductor, con diferentes criterios de evaluación que apoyen la inocencia del sujeto.
This research work determines the validity and credibility of psychosomatic examinations, as a mitigating or aggravating element for traffic judges in the city of Ibarra, towards traffic violations for driving under the influence of alcohol, through qualitative research to a historical documentary compilation in repositories, surveys, sentences and transit appeals and articles, using hermeneutical and systematic work, reiterating its importance in the pro homine principle in prevailing the interpretation of the norms in favor of the innocence of the same, obtaining as results the decision of the free will of the traffic judges arguing existing legal gaps in the current legal regulations, the principle of subjectivity due to the critical self-assessment of the traffic agent and drivers towards psychosomatic tests, all these elements directed towards Art 182 of Transporte Terrestre Tránsito y Seguridad Vial” law organic and its respective Regulation, towards the violation of rights against legal security and presumption of innocence of drivers. Thus, psychosomatic examinations must be a mechanism that fulfills the purpose of contributing as an element of conviction and credibility, for the correct application of due process to the driver, with different evaluation criteria that support the innocence of the subject.
