Abstract
La presente investigación lleva al lector a conocer sobre la reincidencia del procesado en
el derecho penal y la discriminación en razón del pasado judicial, realizando una
explicación sobre el significado de la reincidencia dentro del derecho penal, el objetivo
general de la presente investigación fue determinar si la reincidencia del procesado en el
Derecho Penal vulnera el derecho a la no discriminación en razón del pasado judicial
siendo de gran relevancia debido a que el Ecuador es un estado constitucional de
Derechos en donde el estado tiene la obligación de velar por los mismos, dentro de esta
investigación se usó un método cualitativo a fin de recopilar datos ciertos respecto al
tema, ha sido posible identificar si existe o no vulneración de derechos respecto a la
reincidencia, al ser un modo de pena que castiga de forma agravada un nuevo delito
respecto a uno pasado del mismo tipo penal, por el cual el procesado ya recibió una
sentencia condenatoria, como resultados principales se logró evidenciar que la
reincidencia no vulnera derechos, tampoco vulnera principios del debido proceso.
